Resolution (1) authorizing the conveyance of approximately 3.4538 acres of real property fronting Freeman Drive and bounded by Newmarket Creek to the South in the Crossroads Area and more commonly known as Parcel D-4 by the City of Hampton to the Hampton Redevelopment and Housing Authority, (2) and accepting the transfer of approximately 0.9402 acres of land in the Crossroads Areas more commonly known as a portion of Parcel D-2 from Sandler at Coliseum Central, L.L.C. to the City of Hampton for the City park site adjacent to the H2O Residential Project .

 

RESOLUTION

WHEREAS, the City of Hampton (City) owns a parcel of land in the Crossroads area at Coliseum Central in the City of Hampton, Virginia containing approximately 3.4538+ acres fronting Freeman Drive and bounded by Newmarket Creek to the South and more commonly known as Parcel D-4 as shown on the drawing attached hereto as Exhibit A and entitled Proposed Changes in Property Boundaries for H2O Hampton Roads prepared by Kimley-Horn and Associates, Inc.;

 

WHEREAS, in accordance with the development agreement dated February 25, 2005 between the Hampton Redevelopment and Housing Authority (the Authority) and Sandler at Coliseum Central, L.L.C. (Sandler), as amended by that First Amendment to Development Agreement dated September 13, 2005 and as further amended by that Second Amendment to Development Agreement approved by the Authority on January 10, 2007 (the Development Agreement), Sandler has an option to purchase this parcel from the Authority in lieu of former Parcel D-3 for the development of the Crossroads Project now known as the H2O Residential Project;

WHEREAS, pursuant to its Cooperation Agreement with the Authority for the H2O Residential Project, the City desires to transfer title to the parcel generally described above to the Authority;

 

WHEREAS, in order to preserve the acreage of the City park site designated as Parcel D-3, Sandler is willing to convey, at no cost to the City, approximately 0.9402+, acres of land from the 2.0461+, acres site located off Freeman Drive known as Parcel D-2 and a portion of Parcel D which Sandler acquired from the Authority; and

 

WHEREAS, the City Council of the City of Hampton deems it in the public interest to accept the transfer of the 0.9402+, acres of land from Sandler to be incorporated into the acreage of the designated City park site on Parcel D-3.

 

NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Hampton, Virginia, as follows:

 

1. That it approves the transfer to the Authority of the parcel of land described above as Parcel D-4, containing approximately 3.4538+ acres fronting Freeman Drive and bounded by Newmarket Creek to the South in the Crossroads area at Coliseum Central for development in accordance with the Development Agreement for the H2O Residential Project;

 

2. That the City Manager or his Authorized Designee is authorized to execute and deliver to the Authority any and all necessary legal documents to effectuate the transfer; such documents shall include, but not be limited to, contracts, deeds, releases for sale and transfer, and conveyance of the parcel generally described above in the Crossroads area at Coliseum Central, which parcel may be more specifically described by a survey prepared by the City Engineering Office; and

 

3. That it approves and accepts the transfer of approximately 0.9402+, acres of land from Sandler at Coliseum Central, L.L.C. to be incorporated into the designated City park site adjacent to the H2O Residential Project which deed of conveyance thereof shall be approved, executed and accepted pursuant to the provisions of Virginia Code 15.2-1803.
