Ordinance To Amend And Re-Enact
Articles I and III of Chapter 34 of The City Code Of The City Of Hampton,
Virginia Entitled Streets and Sidewalks By Amending Sections 34-4 and 34-89
Pertaining To Building or Structure-Mounted Communication Antenna Encroachments
Over City Rights-of-Way.
BE IT ORDAINED by the Council of the City of
Hampton, Virginia that Sections 34-4 and 34-89 of Chapter 34 of the City Code
of the City of Hampton, Virginia, be amended and re-enacted as follows:
34 - STREETS AND SIDEWALKS
ARTICLE I. - IN GENERAL
34-4. - Requirements for projecting awnings, wall-mounted signs, gutters,
downspouts, building or structure-mounted communication antennas, and
other appendages to buildings.
(a) Every person who constructs
or maintains an awning, wall-mounted sign, gutter, downspout, building or
structure-mounted communication antennas or other appendage to buildings
projecting over the sidewalks or streets of the city shall take out and keep in
force at all times a public liability insurance policy with limits of not less
than one hundred thousand dollars ($100,000.00) on such awning, wall-mounted
sign, gutter, downspout or such other appendage to buildings. The city shall be
a named additional insured on such policy.

III. - ENCROACHMENTS INTO PUBLIC STREETS AND OTHER PUBLIC WAYS, PLACES OR
34-89. - Exemptions.
The provisions of this Article III
shall not apply to subdivision and neighborhood signs funded through the city's
neighborhood development fund program, and awnings, wall-mounted signs,
gutters, downspouts, building or structure-mounted communication antennas and
other appendages to buildings projecting in, upon and/or over city sidewalks
and streets which are governed by section 34-4 of the City Code.
