An ordinance to amend Chapter 2, Article XIV, of the Code of the City of Hampton entitled Procurement Office" to add a new Section 2-341 to allow for a prequalification process for contractors.

 

 

 

Sec. 2-341 Prequalification of bidders or offerors.

 

(a)   The chief procurement officer or his designee is authorized to prequalify bidders or offerors prior to any solicitation of bids or proposals in accordance with the procedure set forth in Code of Virginia, 2.2-4317(B), whether for goods, services, insurance or construction, by requiring prospective bidders or offerors to submit such information as the chief procurement officer or his designee shall deem appropriate, including samples, financial reports, and references; provided, however, that the opportunity to prequalify shall be given to any prospective bidder or offeror who has not been suspended or debarred from bidding or submitting proposals for city contracts.

 

(b)   The chief procurement officer or his designee may refuse to prequalify any prospective contractor in accordance with the provisions of Code of Virginia, 2.2-4317(B), provided that written reason for such refusal to prequalify shall be made a part of the record in each case. The decision of the chief procurement officer or his designee shall be final.

 

(c)   Prequalification of a bidder or offeror shall not constitute a conclusive determination that the bidder or offeror is a responsible bidder or offeror as defined in Virginia Code Section 2.2-4301, and such bidder or offeror may be rejected as nonresponsible on the basis of subsequently discovered information.

 

(d)   Failure of a bidder or offeror to prequalify with respect to a given procurement shall not bar the bidder or offeror from seeking prequalification as to future procurements or from bidding on procurements which do not require prequalification.
