GOING-OUT-OF-BUSINESS SALES

 

DIVISION 1.

 

GENERALLY

 

Sec. 33-16. Violations of article.

 

A violation of any provision of this article shall constitute a Class 1 misdemeanor.

Sec. 33-17. Advertisement or sale of uninventoried goods.

 

It shall be unlawful for any person connected with a sale authorized by a permit issued under this article to advertise at a reduced price or to sell at a reduced price, during the period covered by such permit, any goods that are not specified in the inventory filed pursuant to section 33-32.

Sec. 33-18. Inspections.

 

The commissioner of revenue shall inspect the advertisement and conduct of a sale authorized by a permit issued under this article to ensure that it is advertised and conducted in conformity with such permit.

DIVISION 2.

 

PERMIT

 

Sec. 33-31. Required.

 

It shall be unlawful for any person to advertise or conduct a sale for the purpose of discontinuing a retail business, or to modify the word "sale" in any advertisement with the words "going out of business" or any other words which tend to insinuate that the retail business is to be discontinued and the merchandise liquidated, unless such person has a valid permit to conduct such sale issued by the commissioner of revenue.

Sec. 33-32. Application.

 

Application for a permit required by this division shall be on a form supplied by the commissioner of revenue and filed with such commissioner. The application shall be accompanied by an inventory, including the kind and quantity of all goods which are to be offered for sale during the sale and by a sample copy of any advertisement of the sale intended to be published in any newspaper. Such application must be submitted at least thirty (30) days prior to the date the sale is to begin.

Sec. 33-33. Fee.

 

A fee of sixty-five dollars ($65.00) shall be charged for each permit issued under this article.

Sec. 33-34. Issuance.

 

The commissioner of revenue shall issue a permit required by this division to retail merchants upon the filing of a proper application and payment of the prescribed fee.

Sec. 33-35. Term.

 

A permit issued under this division shall be valid for a period of no longer than sixty (60) days, and any extension of that time shall constitute a new sale and shall require an additional permit and inventory list. A maximum of one permit beyond the initial sixty-day permit shall be granted solely for the purpose of liquidating only those goods contained on the initial inventory list and which remain unsold.
