Resolution Authorizing Acquisition by Condemnation or Negotiation of Property for Right-of-Way Improvements of the Armistead Avenue Connector, Phase IB.

 

CITY PROJECT NO. 02-018B, VDOT PROJECT NO: U000-114-F14, RW-203, UPC#67200, FEDERAL #STP-5403(975)

 

WHEREAS, Council had previously approved the Location and Major Design features of the Armistead Avenue Connector, Phase I project at its September 10, 2003 meeting, following a public hearing on the project conducted on August 20, 2003; and

 

WHEREAS, the advertisement for the August 20,2003 public hearing was not placed in the newspaper 30 days in advance of the hearing, as required by VDOT; and

 

WHEREAS, following September 30th and October 21st advertisements, a second public hearing was conducted on November 3, 2003, in the City of Hampton by representatives of the Virginia Department of Transportation (VDOT) and the City, after due and proper notice for the purposes of considering the proposed location and design of the Armistead Avenue Connector, Phase 1, in the City of Hampton, at which meeting project plans and other pertinent information were made available for public inspection according to State requirements; and

 

WHEREAS, the project scope includes the improvements to the intersection of Armistead Avenue and Mercury Boulevard and widening of Armistead Avenue, from the Mercury Boulevard intersection south, to the Reese Drive intersection, and the construction of a new roadway from Armistead Avenue, at the Reese Drive intersection, to the vicinity of the Coliseum, with appropriate lighting and landscape and other improvements; and

 

WHEREAS, all persons and parties in attendance were afforded full opportunity to participate in said public meetings; and

 

WHEREAS, representatives of the City of Hampton were present and participated in said meetings; and

 

WHEREAS, Council previously requested the Virginia Department of Transportation to program this project; and

 

WHEREAS, Council considered all such matters; and

 

WHEREAS, the Council of the City of Hampton, at its December 3, 2003 meeting approved a resolution approving location and major design features of the proposed project, authorized the acquisition of rights-of-way necessary for this project, and approved the conveyance of easements necessary for the project; and

 

WHEREAS, as part of the project the Council deems it necessary to acquire property and temporary construction easements for the new access road from North Armistead Avenue to the Hampton Coliseum and Convention Center complex and for road improvements to North Armistead Avenue and reconfiguration of the Pine Chapel road and North Armistead Avenue intersection and improvements to the intersection of Mercury Boulevard and North Armistead Avenue; and

 

WHEREAS, the construction of the new access road from North Armistead Avenue to the Hampton Coliseum and Convention Center complex and the road improvements to North Armistead Avenue and Pine Chapel Road and the related intersections and will serve a public purpose by improving the Citys transportation network and creating a more efficient transportation system.

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Hampton, Virginia, that following a public hearing, it approves and directs the acquisition of property and temporary construction easements located within the project area and designated on the attached Exhibit A for the public purposes set out above by negotiation or condemnation.

 

BE IT FURTHER RESOLVED that the City Attorney be and is hereby authorized and directed to institute negotiations and condemnation proceedings as authorized by the Code of Virginia of 1950, as amended, for the acquisition of the necessary rights-of-way from the land owners which are designated on the attached Exhibit A, but nothing in this resolution shall be construed as preventing negotiation by the City Attorney and/or City Manager or his designee for the purchase of any and all of said property and temporary construction easements at a private sale should the owners there agree to sell at the prices offered.

 

BE IT FURTHER RESOLVED by the Council of the City of Hampton, Virginia that the City Manager be authorized to file certificates of take in accordance with Chapter 1, Article VII of Title 33.1 of the Code of Virginia of 1950, as amended, against parcels located within the project area which are designated on the attached Exhibit A.
