AN ORDINANCE PROVIDING FOR THE EXONERATION OF CERTAIN TAXES ASSESSED AGAINST MONROE APARTMENT CORPORATION LOCATED AT FORT MONROE FOR THE FISCAL TAX YEAR 2005/2006.

 

 

WHEREAS, the City of Hampton, Virginia, has assessed for the fiscal tax year 2005/2006 against Monroe Apartment Corporation real estate taxes on their leasehold property described on the land books as "Ft. Monroe Apts. 24 Ac.", all located on Fort Monroe Military Reservation, in the amount of $48,900.00; and

WHEREAS, the designee of the Secretary of Defense has determined that in accordance with Section 511 of the National Housing Act of 1956 (53 U.S.C. #1594, note), Monroe Apartment Corporation is entitled to a set-off against such real estate taxes; and

WHEREAS, Monroe Apartment Corporation will pay the sum of $24,450.00, said sum being one-half of the tax assessed and being due and payable on or before June 5, 2006; and

WHEREAS, the Council of the City of Hampton, Virginia, believes, upon recommendation of the City Attorney, that the correction of said tax assessed by exonerating Monroe Apartment Corporation from the payment of $24,450.00, which is due and payable on or before December 5, 2005, is in the best interest of the City.

NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Hampton, Virginia, that the tax for the fiscal tax year 2005/2006 against Monroe Apartment Corporation on that land, or interest therein, described on the land book as "Ft. Monroe Apts. 24 Ac." be corrected from $48,900.00 to $24,450.00; that Monroe Apartment Corporation be exonerated from paying the sum of $24,450.00, which is due December 5, 2005; and that the sum of $24,450.00 will be paid on or before June 5, 2006, the tax bill for 2005/2006 shall be deemed satisfied and no penalty or interest shall be assessed on said bill.

BE IT FURTHER ORDAINED by the Council of the City of Hampton, Virginia, that certified copies of this Ordinance be forwarded to the City Treasurer and the Board of Assessors by the Clerk of this Council.

 

Adopted at the regular meeting of the City Council of the City of Hampton, Virginia held on January 11, 2006.
