Resolution appropriating $113,000 from the Economic Development Fund to the Department of Economic Development for repairs to be made within the Hampton Roads Center Central and South Campuses

 

WHEREAS, the Industrial Development Authority of the City of Hampton, Virginia (the IDA) is the owner of certain real property located in Hampton Roads Center Central and South Campus (Hampton Roads Center) within the City of Hampton, Virginia;

 

WHEREAS, the IDA, as Declarant, caused certain Protective Provisions and Covenants for Hampton Roads Center dated November 21, 1986, (the Declaration) to be recorded and be binding upon the properties located within the area described therein;

 

WHEREAS, under the terms of the Declaration, the Hampton Roads Center Owners Association (the Association) is required to maintain common areas, medians, irrigation systems, entrance signs and cover the cost of utilities and insurance of those common areas within Hampton Roads Center;

 

WHEREAS, the IDA conveyed the medians in the public streets in Hampton Roads Center to the City at the inception of the office park, and the City has been maintaining the medians without making certain required repairs such as repair of the irrigation system in HRC Central Campus within the median of Butler Farm Road; relocation of an electrical service panel in HRC South Campus to higher ground; removal of the H located in the pond in HRC South Campus and removal of a 45 foot dead tree adjacent to the Hampton Roads Center interstate sign that poses a safety issue;

 

WHEREAS, in order for the Association to maintain the medians as required under the Declaration, a landscape maintenance easement must be granted by the City;

 

WHEREAS, as a condition precedent to the Association entering into a landscape maintenance easement, the Association has requested the City to undertake the repairs as aforesaid;

 

WHEREAS, it is in the best interest of the City for the Association to assume the maintenance of the medians, irrigation systems and entrance signs and cover the cost of insurance and utilities; and

WHEREAS, in order to shift the burden and cost of maintaining the medians, irrigation system, entrance signs and the costs of utilities and insurance, the City desires to undertake the existing repairs in Hampton Roads Center subject to obtaining the necessary funding in the amount of $113, 000.00.

 

NOW, THEREFORE, BE IT RESOLVED by the Hampton City Council as follows:

 

1. That it approves the appropriation of $113,000 from the Economic Development Fund to the Economic Development Department for the purpose of making the required repairs within Hampton Roads Center Central and South Campuses; and

 

2. That prior to the City making such repairs, the City secure in writing, the Associations agreement to execute a landscape maintenance easement which will be presented to City Council for approval.
