Resolution Initiating Consideration of Amendment to Section 5-1 of the Zoning Ordinance to Allow Churches with an Assembly Area capacity of 700 People on a Residential Street.

 

WHEREAS, the Code of Virginia, 15.2-2286 permits landowners and contract purchasers of property to petition the governing body to amend the text of the Zoning Ordinance; and

 

WHEREAS, the Hampton Zoning Ordinance, Chapter 5-1, does not permit churches on residential streets; and

 

WHEREAS, Bethel A.M.E. Church is the contract purchaser of property at the termini of four residential streets; and

 

WHEREAS, Bethel A.M.E. Church requests the City Council to approve a resolution to consider amending the Zoning Ordinance to permit churches with an assembly area capacity of 700 people on residential streets; and

 

WHEREAS, if this amendment is approved, it will apply to all residential streets within the City; and

 

WHEREAS, the City Council is of the opinion that the public necessity, convenience, general welfare, and good zoning practice warrant the consideration of such amendments.

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of Hampton, Virginia, does hereby request staff to initiate review of Section 5-1 of the Zoning Ordinance to permit churches with an assembly area capacity of 700 people on residential streets. This proposed zoning ordinance amendment is referred to the Planning Commission for its recommendation to City Council and the Planning Commission shall hold at least one public hearing on this matter in accordance with law.

 

Adopted at the regular meeting of the City Council of the City of Hampton, Virginia held on June 18, 2008.
