Resolution Authorizing the Execution of a Lease for 1,600 sq. ft. of City-owned Land and the Granting of (a) a 25,608.1 sq. ft. Ingress/Egress Easement, (b) a 4,447.8 sq. ft Power Easement, (c) a 2,791.0 sq. ft. Telephone Easement, and (d) a 357.4 sq. ft. Duct Bank Easement over City-owned Property Located at 300 Butler Farm Road to New Cingular Wireless, PCS, L.L.C. for a Power Equipment Compound.

 

WHEREAS, the City of Hampton owns a parcel of land on 300 Butler Farm Road (the Property) upon which the new Teen Center is located;

WHEREAS, there is currently a Dominion Virginia Power tower on a separate City-owned site adjacent to the Property;

WHEREAS, New Cingular Wireless PCS, LLC (New Cingular) proposes to co-locate an antenna on the Dominion Virginia Power tower, however the co-location requires the construction of a telecommunications facility/equipment compound (the Facility) on the Property to serve the antenna;

WHEREAS, City staff has negotiated a five-year lease with New Cingular to lease 1,600 square feet to the west of the Teen Center (the Premises)on the Property for the construction of the Facility and related access and utility easements for the cable and wiring between the Facility and the Dominion Power tower; and

WHEREAS, the lease of the Premises and the granting of the access and utility easements to New Cingular are deemed fair and reasonable, and the terms of the Lease Agreement and the Deed of Easement, a copy of which is attached to this Resolution, are reasonable and acceptable.

NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Hampton, Virginia, as follows:

1. That the lease of 1600 square feet to the west of the Teen Center located at 300 Butler Farm Road together with the easements for access and utilities are hereby approved.

2. That the City Manager or his designee is hereby authorized and directed to execute the Lease Agreement and the Deed of Easement between the City of Hampton and New Cingular Wireless PCS, LLC, a Delaware limited liability company, as set forth in this Resolution.

Adopted at the regular meeting of the City Council of the City of Hampton, Virginia held on April 30, 2008.
