Resolution Authorizing The Creation Of A Separate Entity Exempt From Federal Taxation Under Internal Revenue Code 501(C)(3) To Solicit Private Funding To Support The Hampton Mayors Committee For People With Disabilities.

 

RESOLUTION

WHEREAS, the Hampton Mayors Committee For People With Disabilities (Committee) is organized and solemnly dedicated to assisting disabled citizens of the City of Hampton, Virginia (City) regardless of race, color, or creed; and

 

WHEREAS, the Committee develops and conducts educational programs for the public; for professional physically, emotionally, intellectually and vocationally disabled within the community; and

 

WHEREAS, the Committee proposes programs and services in health, welfare, education, recreation and employment which are necessary for the interests of people with disabilities; and

 

WHEREAS, the Committee cooperates and consults with other committees, agencies and organizations concerning people with disabilities; and

 

WHEREAS, the Committee reviews and makes recommendations to appropriate organizations concerning people with disabilities; and

 

WHEREAS, the Committee undertakes such special projects in the interest of people with disabilities as the City of Hamptons Mayor may assign; and

 

WHEREAS, the Committee represents the Office of the City of Hamptons Mayor as appropriate; and

 

WHEREAS, the Committee seeks to expand their efforts and activities through private funding and to minimize expenditure of City monies by incorporating, obtaining tax exempt status pursuant to Internal Revenue Code (IRC) 501(c)(3), and partnering with the City; and 

 

WHEREAS, the City Manager, in support of the Committee in this regard, requests the City of Hamptons Council to authorize him to establish a separate 501(c)(3), non-profit entity to solicit and receive funds from private funding sources not otherwise available to the City that are specifically allocated to non-profit organizations grants, private donations, property gifts, etc. to support the Committee herein; and

 

WHEREAS, the City of Hamptons Council acknowledges that the creation of such an entity requires its authorization and appropriate direction to the City Manager to cause to be drafted and filed Articles of Incorporation and other documents as necessary in the entity formation process.

 

NOW THEREFORE, BE IT RESOLVED by the City of Hamptons Council

(1) that the City Manager is hereby authorized and directed to take the steps necessary to create a separate entity exempt from federal taxation under IRC 501(c)(3) to solicit private funding to support the Committee, under such name as shall be determined by the City Manager; (2) that the stated purpose of the entity shall be to assist the Citys disabled citizens regardless of race, color, or creed; and (3) that the staff shall proceed with all necessary filings as soon as practicable.
