An Ordinance To Suspend Payment Of Certain Fees Associated With Permits Required To Repair Or Replace Property Damage Occasioned By Hurricane Sandy

 

BE IT ORDAINED by the City Council of Hampton, Virginia, that the Code of the City of Hampton, Virginia, be amended and re-enacted to read as follows:

 

 

WHEREAS, the Hampton Director of Emergency Management properly issued a Declaration of Local Emergency at 12:00 p.m. on October 27, 2012 due to the expected storm surge, high winds, wind storms, heavy rains and flood conditions caused by Hurricane Sandy; and

 

WHEREAS, the storm surge, high winds, wind storms, heavy rains and flood conditions of Hurricane Sandy impacted the City of Hampton from late Saturday, October 27 through Tuesday, October 30, causing property damage, in addition to loss of electric power for many city residents; and

 

WHEREAS, in order to facilitate disaster recovery and property repair, the City Manager, as the Hampton Director of Emergency Management, recommends that the requirement to pay fees for permits required to repair or replace property damage caused by the Hurricane Sandy be temporarily suspended; and

 

WHEREAS, the Council of the City of Hampton agrees with the recommendation of the City Manager/Director of Emergency Management, and wishes to memorialize the suspension of such fees until such time as further action is taken by this City Council.

 

NOW, THEREFORE BE IT ORDAINED by the Council of the City of Hampton, Virginia, that:

 

1. It hereby suspends the requirement for payment of fees to obtain permits necessary to repair or replace property damaged by Hurricane Sandy until such time as further action is taken by City Council.

 

2. The City Manager is authorized to suspend the payment of any other fees she feels is necessary and proper for the orderly recovery of the City from this natural disaster visited upon the City of Hampton and its residents by Hurricane Sandy and all reasonable actions of the manager in this regard taken since the declaration of local emergency on October 27, 2012 are hereby approved and ratified.

3. The City Manager is directed to keep records of the fees that are suspended in order that the City may accurately account for and report the costs associated with the recovery efforts necessitated by Hurricane Sandy.

 

4. This ordinance shall be in effect on and after November 5, 2012.

 

Adopted at a special meeting of the City Council of the City of Hampton, Virginia, held on November 5, 2012.
