Resolution Accepting and Appropriating $731,725.16 Generated By Law Enforcement Investigation Activity and Accepting Tangible Personal Property Acquired Pursuant to Law Enforcement Investigative Activity

 

RESOLUTION

WHEREAS, pursuant to a Memorandum of Understanding with the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), the Hampton Police Division for a period from July 2010 through early 2011, assisted the ATF in undercover investigative activities regarding illegal cigarette trafficking involving cigarette purchases funded by ATF;

WHEREAS, the investigative sales activity generated funds and involved the purchase of goods with those funds in furtherance of the investigation, which funds and goods were left in the custody of the Hampton Police Division following the cessation of ATF involvement in the investigation, whereupon additional funds were generated by the Hampton Police Division, which made additional purchases of goods in support of the law enforcement effort;

WHEREAS, the investigation has concluded with investigative funds remaining of $731,725.16 (SEVEN HUNDRED THIRTY ONE THOUSAND SEVEN HUNDRED TWENTY FIVE DOLLARS and SIXTEEN CENTS), and investigative equipment/supplies on hand as set forth in Exhibit A, attached, and the ATF has stated that it has no ownership interest in the funds or goods which, therefore, by operation of law accrue to the City of Hampton;

WHEREAS, the city manager recommends and this Council agrees that it is in the best interest of the City to put the funds to the use of the City in support of the Safe and Clean initiative, with a specific emphasis on youth crime/violence prevention and to put the goods to the use of the city in support of city operations, or to dispose of or transfer such assets where warranted, as the manager deems appropriate.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Hampton, Virginia that (1) $731,725.16 remaining from the Hampton Police Division investigation described in this Resolution is hereby accepted and appropriated for use by the City Manager in support of the Safe and Clean initiative, with a specific emphasis on youth crime/violence prevention in the city; and (2) goods purchased in the course of the investigation are hereby accepted and the city manager is authorized and directed to put the goods to use in support of city departmental operations or to dispose of or transfer certain of the assets as may be appropriate under the law, in her discretion; and (3) that any prior act deemed an acceptance by the City of the money and goods described here is hereby ratified.
