Ordinance to Amend and Reenact Article III of Chapter 2 Entitled "Officers and Employees Generally" of the City Code of the City of Hampton, Virginia by Adding Section 2-114 Pertaining to the Legal Department.

 

 

WHEREAS, Section 5.01 of the Charter of the City of Hampton authorizes the establishment of a legal department managed and controlled by the city attorney;

 

and

 

WHEREAS, Section 5.01 of the Charter of the City of Hampton, Virginia further authorizes the enactment of an ordinance setting forth the composition of such legal department:

 

BE IT ORDAINED by the Council of the City of Hampton, Virginia, that Chapter 2, of the City Code of the City of Hampton, amended and reenacted to read as follows:

 

Section 2-114. Legal Department

 

(A)               The city attorney is authorized and empowered to appoint deputy city attorneys, assistant city attorneys and any other employees necessary to effectively operate and maintain a legal department, within the limitation of the funds provided for the purpose by city council. All deputy and assistant city attorneys shall serve at the pleasure of the city attorney and may be removed from their position by the city attorney. The deputies and assistants shall, so far as required by the city attorney, discharge and perform any of the duties of the city attorney and, in the discharge of such duties, shall be under the direction and control of the city attorney.

(B)              The city attorney may also, from time to time, appoint special counsel who shall perform such legal duties as may be required, and at such compensation as may be agreed upon.

(C)              The city attorney is further authorized to enter into an agreement with the commonwealths attorney pursuant to Virginia Code 15.2-1542(D) to allow the city attorney to handle the prosecution of particular criminal misdemeanors.
