ORDINANCE TO AMEND AND REENACT NON-CODED ORDINANCE #950, SECTION II AND SECTION III PERTAINING TO BAY DAYS, ADOPTED ON AUGUST 14, 2002.

 

Section II

(h) It shall be unlawful for any person to operate a golf cart, or any other similar vehicle that is not a personal assistive mobility device within the festival area without the specific written authorization of the City Manager.

Section III

Whenever any person is stopped or detained by a law enforcement officer for a violation of provisions II(a), II(b), II(c), II(d), II(e) or II(h) of this ordinance, the person will first be given the opportunity to comply by either ceasing the prohibited activity or leaving the festival area. Any person, who refuses to comply with provisions II(a), II(b), II(c), II(d), II(e) or II(h) of this ordinance, after having been warned to do so, shall be issued a summons for the violation of provisions II(a), II(b), II(c) II(d), II(e) or II(h) of this ordinance. Violation of provisions II(a), II(b), II(c), II(d), II(e) or II(h) of this ordinance shall be punishable as a Class 4 misdemeanor.
