Resolution Amending the Resolution Establishing the Purchasing and Procurement Oversight Committee to Conform Member Term Limits to City Charter Requirements and Set Quorum

 

 

RESOLUTION

 

WHEREAS, the members of the Purchasing and Procurement Oversight Committee have been charged with the responsibilities of (a) reviewing purchasing and contractual procedures and practices of all agencies and departments of the city; (b) recommending improvements that would result in cost effectiveness, simplicity, greater fairness and broader representation of the community; and (c) monitoring results; and

WHEREAS, since its inception, the Purchasing and Procurement Oversight Committee has been instrumental in expanding the citys vendors list, thus creating a greater source for supplies and services; and

WHEREAS, this committee has developed and implemented a mechanism for statistically tracking and monitoring bids and contracts awarded to small and disadvantaged businesses; and

WHEREAS, the committee has been instrumental in conducting a series of seminars and specialized workshops to benefit the small and minority business person;

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Hampton, Virginia as follows:

Section 1. Establishment of the Purchasing and Procurement Oversight Committee as a Permanent Committee.

The Purchasing and Procurement Oversight Committee shall be established on a permanent basis. It shall be an advisory board to the Procurement Division of the Finance Department and shall make quarterly reports.

Section 2. The Purchasing and Procurement Oversight Committee; Members.

The Committee shall consist of eleven (11) members who shall be Citizens of the city and appointed by the Council and as such shall serve without compensation.

Section 3. Purchasing and Procurement Oversight Committee; Terms of members; Vacancies.

Members of the Committee shall be appointed to a four-year term.

a. Two members of the committee shall be initially appointed for one year. They shall be eligible for reappointment.

b. Membership shall be limited to two (2) consecutive terms. Any vacancy on the Committee shall be filled by the Council for the unexpired term.

c. One member shall be a member of the Council

d. One member shall be a member of the Hampton City School Board.

e. The Director of Finance shall be an ex-officio member without a vote.

Section 4. The Purchasing and Procurement Oversight Committee; Chairperson; Meetings; Quorum.

The Committee shall elect a chairperson from its membership. The Committee shall hold regular meetings monthly and keep a record of its proceedings which shall be public record to the extent required by the Virginia Freedom of Information Act. A quorum shall consist of six (6) members.

Section 5. The Purchasing and Procurement Oversight Committee; Powers and Duties.

The Committee shall act in an advisory capacity to the Director of Finance.

The Committee shall:

a. Review purchasing and contractual procedures and practices of all agencies and departments of the city.

b. Recommend improvements that would result in cost effectiveness, simplicity, greater fairness and broader representation of the

community.

c. Monitor the participation of small and minority businesses in the citys procurement process.
