Ordinance Authorizing the Transfer of City Property Located at 17 Freeman Drive, Containing a Parcel for Pump Station 119 (LRSN 13001523), Comprising 2,500 Square Feet (0.0574 Acre), More or Less, and the Remaining Parcel at 17 Freeman Drive (LRSN 7000111), Comprising 12,508 Square Feet (0.2871 Acre), More or Less, from the City of Hampton to Hampton Roads Sanitation District

 

WHEREAS, the City is the fee simple owner of two parcels of land in Hampton, Virginia located at 17 Freeman Drive, one containing the parcel for Pump Station 119 (LRSN 13001523), comprising 2,500 square feet (0.0574 acre), more or less, and the remaining parcel of 17 Freeman Drive (LRSN 7000111), comprising 12,508 square feet (0.2871 acre), more or less (the Property);

WHEREAS, as a matter of course, Hampton Roads Sanitation District (HRSD) owns and operates pump stations treating wastewater flows of more than 1 million gallons per day, in part, to control treatment and flow direction, either to the York River or the HRSD Boat Harbor Treatment Plant;

WHEREAS, Pump Station 119, currently owned and operated by the City, was built to service the nearby H2O development and surrounding properties;

WHEREAS, Pump Station 119 subsequently began servicing the Trail Creek Apartments (also known as the Oxford Trail development) located at 2 Abbott Drive;

WHEREAS, the properties being serviced by Pump Station 119 increases the overall wastewater flow of this facility and aligns with HRSDs threshold policy;

WHEREAS, City staff recognizes that HRSD needs operational flexibility of Pump Station 119 to achieve the regional goals of operation and maintenance and recommends transfer of the Property to HRSD; and

WHEREAS, Council has determined that the transfer of the Property to HRSD for Pump Station 119 to be owned and operated by HRSD will further preserve and protect the health, safety and welfare of the residents of the service areas and the citizens of Hampton and accordingly, is in the best interest of the City.

NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of Hampton, Virginia, as follows:

1. That the transfer of the City properties located at 17 Freeman Drive to Hampton Roads Sanitation District is approved and authorized; and

2. That the City Manager or her designee and the Clerk of Council are authorized to execute and deliver all legal documents necessary to effect the transfer.

 

Adopted at the regular meeting of the City Council of the City of Hampton, Virginia, held on the 12th day of August, 2015.

This ordinance requires an affirmative recorded vote of three-fourths of all members elected to Council.
