Resolution to approve the conveyance of a parking easement for two (2) parking spaces located at the City lot on Wine Street adjacent to 34 Wine Street to Joseph J. Stellute (32 Wine Street -one space) and Business Enterprise Partners, Inc. (34 Wine Street - one space).

 

RESOLUTION

WHEREAS, WHEREAS, on August 31, 2007 the City of Hampton (the City ) acquired the parcel of real property located at the intersection of Lincoln and Wine Street more commonly known as 505 Wine Street from Syms-Eaton, Inc., (the Syms-Eaton Site), which parcel is comprised of vacant land adjacent to Lincoln Street, a parking lot and a second area of open space adjacent to the Citys Wine Street parking lot;

WHEREAS, the Syms-Eaton Site was purchased for the potential relocation of SunTrust Banks existing branch operations on Queens Way;

WHEREAS, in order to maximize the development of the Syms-Eaton Site, connectivity between the two vacant land areas is paramount and thus requires the removal of two parking spaces currently subject to a parking easement granted by Syms-Eaton, Inc. to the owners of the commercial building known as Units 32-40 Wine Street (the Syms-Eaton Parking Easement) as shown on the Exhibit attached hereto;

WHEREAS, the owners of Units 32-40 Wine Street agreed to the termination of the Syms-Eaton Parking Easement over the two subject parking spaces subject to the Citys conveyance of a parking easement for two parking spaces on the Citys Wine Street lot to the owners of 32 Wine Street (Joseph J. Stellute) and 34 Wine Street (Business Enterprise Partners, Inc. a/k/a Net Results) to fulfill the original legal obligation of providing nine parking spaces to the owners of Units 32-40 Wine Street;

WHEREAS, City staff has determined that the relocation of the two parking spaces to the subject site is pivotal in that the footprint of the proposed mixed-use project at the Goodyear site as well as the size of the parking garage associated with the mixed-use project will be influenced by the relocation of SunTrust to the Syms-Eaton Site; and

WHEREAS, City Council has determined that the conveyance of the parking easement for the subject parking spaces is strategic for the redevelopment and revitalization of downtown Hampton and is manifestly in the public interest.

NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Hampton, Virginia, as follows:

1. That the conveyance of a parking easement for two (2) parking spaces located at the City lot on Wine Street adjacent to 34 Wine Street to Joseph J. Stellute (32 Wine Street- one space) and Business Enterprise Partners, Inc. (34 Wine Street-one space) is hereby approved; and

2. That the City Manager or his designee is hereby authorized and directed to execute the deed of easement necessary to convey the parking easement as set forth in this Resolution.

Adopted at the regular meeting of the City Council of the City of Hampton, Virginia, held on September 26, 2007.

 

THIS RESOLUTION REQUIRES AN AFFIRMATIVE VOTE OF THREE-FOURTHS OF ALL OF THE MEMBERS ELECTED TO COUNCIL.
