Ordinance to Amend and Reenact the Zoning Ordinance of the City of Hampton, Virginia by Amending Article V of Chapter 8 Entitled, Downtown Districts Pertaining to Development and Lot Size Standards Including Standards for Permitted Uses and Article III of Chapter 9 Entitled, O-CC District Coliseum Central Overlay Pertaining to Modifications to Permitted Uses.

 

WHEREAS, the public necessity, convenience, general welfare, and good zoning practice so require;

 

BE IT ORDAINED by the City Council of the City of Hampton, Virginia, that sections 8-42, 8-43, and 9-23 of the Zoning Ordinance of the City of Hampton, Virginia be amended to read as follows:

 

CHAPTER 8 - SPECIAL DISTRICTS

ARTICLE V. - DOWNTOWN DISTRICTS

Sec. 8-42. - DT-1 DistrictDowntown Business.

(1) Permitted uses. Uses shall be permitted as set forth in chapter 3Uses Permitted.

(2) Development and lot size standards.

(a) Permitted retail sales, services, and office uses shall be conducted wholly within an enclosed building except for:

(i) Bank, with drive-through;

(ii) Boat sales;

(iii) Gas station;

(iv) Outdoor dining, downtown;

(v) Parking lot;

(vi) Restaurant, including drive-through

(vii) Rummage sale, temporary; and

(viii) Those uses authorized by a Special Event Permit issued pursuant to the Hampton City Code; and

(ix) Seasonal sales authorized by Section 34-7 of the City Code.

(b) No more than fifty (50) percent of the floor area of any building shall be used for the storage of merchandise.

 

(c) There shall be no minimum lot areas or lot dimensions.

(1) Permitted uses. Uses shall be permitted as set forth in chapter 3Uses Permitted.

(2) Development and lot size standards.

(a) Permitted retail sales, services, and office uses shall be conducted wholly within an enclosed building except for:

(i) Bank, with drive-through;

(ii) Boat repair;

(iii) Boat sales;

(iv) Gas station;

(v) Outdoor dining, downtown;

(vi) Parking lot;

(vii) Restaurant, including drive-through;

(viiI) Rummage sale, temporary;

(ix) Those uses authorized by a Special Event Permit issued pursuant to the Hampton City Code; and

(x) Seasonal sales authorized by Section 34-7 of the City Code.

(b) No more than fifty (50) percent of the floor area of any building shall be used for the storage of merchandise.

ARTICLE III. - O-CC DISTRICTCOLISEUM CENTRAL OVERLAY

Sec. 9-23. - Modifications to permitted uses.

(2) Permitted retail sales, services, and office uses shall be conducted wholly within an enclosed building except for:

(a) Car wash, self-service or automated;

(b) Gas station;

(c) Motorcycle sales;

(d) Outdoor dining;

(e) Parking lots;

(f) Vehicle sales, new;

(g) Vehicle storage; and

(h) Those uses authorized by a Special Event Permit issued pursuant to the Hampton City Code;

(i) Seasonal sales authorized by Section 34-7 of the City Code.

(j) Permanent outdoor sales, displays, and storage, which shall be permitted only within a physically defined area that is shown on the site plan, and all physical improvements defining that area must be constructed of materials comparable to the primary building(s) on the site.

(3) No more than fifty (50) percent of the floor area of any building shall be used for the storage of merchandise.
