Resolution Determining Mack Manufacturing to be the Only Source Practicably Available from which to Procure Crane Grapple Bucket Parts for the Hampton Department of Public Works and Authorizing the Negotiation and Executive of a Purchase Contract with Mack Manufacturing.

 

 

WHEREAS the Hampton City Council recognizes the public interest in providing refuse management through Hamptons Steam Plant, a division of the Department of Public Works;

 

WHEREAS the Hampton City Council recognizes that the Steam Plant, as one of only five waste combustion facilities operating in the Commonwealth of Virginia, uses and maintains equipment which is unique;

 

WHEREAS the Steam Plant to provide efficient refuse management must operate 24 hours per day;

WHEREAS the Steam Plant previously purchased two Mack crane buckets, and as a result needs Mack crane bucket parts;

 

WHEREAS Mack Manufacturing is the original designer and manufacturer of the crane grapple bucket used by the Steam Plant;

 

WHEREAS other vendors would have to attempt to fabricate the parts, which is both time-consuming and costly, and which would likely result in the closure of the Steam Plant during fabrication;

 

WHEREAS Mack Manufacturing has the needed parts available upon demand; and

 

WHEREAS Mack Manufacturing has offered a reasonable price for said parts;

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Hampton, Virginia as follows:

 

1. That the contract for procuring the parts described above may be negotiated and awarded to Mack Manufacturing as a sole source without competitive sealed bidding or competitive negotiation as set forth in Virginia Code 2.2-4303(E);

 

2. That the City Manager or his authorized designee is hereby authorized to negotiate and execute a purchase contract with Mack Manufacturing; and

 

3. That the notice awarding the contract to Mack Manufacturing shall be posted in a public place pursuant to Virginia Code 2.2-4303(E).
