Resolution Regarding the Disposition of City Property Pursuant to Resolution No. R-2006-00207




WHEREAS, on April 12, 2006, the City Council of the City of Hampton, Virginia (the "Council") adopted Resolution No. R-2006-00207 setting forth the policy for the initiation of City Economic Development proposals involving City-owned property wherein all legislative actions, including, but not necessarily limited to property dispositions necessary to accomplish City economic development objectives involving City-owned property, shall originate with and remain under the legislative authority of the Council; and

WHEREAS, in furtherance of its policy, Council desires to ensure the greatest level of and opportunity for public participation and input in the decision governing the sale, transfer or lease, franchise or use of property owned by the City through a public hearing process to be held prior to the disposition of such property.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Hampton, Virginia as follows:


1.                  That no City-owned property, whether improved or unimproved, shall be disposed of until the City Council has held a public hearing concerning such disposal, and provided further that the holding of a public hearing shall not apply to the leasing of City-owned property to another political subdivision or authority of the Commonwealth of Virginia, or the vacation of the City easements, streets, alleys and rights-of way either under its Charter provisions or pursuant to State subdivision and zoning provisions as set forth by State law.

2.                  That all prior dispositions of City-owned property to any private person or entity or any public entity, political subdivision or authority are in all respects approved, ratified and confirmed.

3.                  That this Resolution shall be effective upon its adoption.
