Ordinance Approving the Vacation of a Portion of Right of Way Known as Dooley Street Comprising 3,950 Square Feet (0.0907 Acre), More or Less, to Interlock Paving Systems, Inc.

 

WHEREAS, the City owns the unimproved right of way of Dooley Street, a portion of which comprises 3,950 square feet (0.0907 acre), more or less (the Vacation Area);

WHEREAS, Interlock Paving Systems, Inc. (Interlock) owns properties abutting the Vacation Area, that is, (i) to the north, a lot identified as 519 N. Back River Road (LRSN 2000750), (ii) to the west, a vacant lot identified as LRSN 2000619, (iii) to the east, an unimproved lot identified as LRSN 2000575, an unimproved lot identified as 426 Dooley Street (LRSN 200576), and an unimproved lot identified as LRSN 2000583, and (iv) to the south, a vacant lot identified as LRSN 13000458;

WHEREAS, the City previously vacated a portion of Dooley Street to Interlock via a Vacation Agreement dated January 11, 2002, and recorded in the Clerks Office of the City of Hampton at Instrument No. 020001300, page 595;

WHEREAS, Interlock currently requests the vacation of the Vacation Area because the Vacation Area is an unbuildable, land-locked unimproved right of way, abutting property owned by Interlock to the north, west, east, and south as illustrated on the exhibit attached to the Vacation Agreement;

WHEREAS, the Vacation Area is valued at One Thousand One Hundred and 00/100 Dollars ($1,100.00);

WHEREAS, local public utility companies and city staff have reviewed this request, none of which have any objection;

WHEREAS, the Vacation Area will not be needed for any public purpose; and

 

WHEREAS, pursuant to Chapter 34, Article V of the Code for the City of Hampton, City Council agrees to vacate the right of way known as Dooley Street, comprising 3,950 square feet (0.0907 acre), more or less, for the purchase price of $1,100.00.

 

NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of Hampton, Virginia, as follows:

 

1. That the vacation of a portion of the right of way known as Dooley Street, comprising 3,950 square feet (0.0907 acre), more or less, is approved;

 

2. That the City Manager, or her authorized designee, and Clerk of Council are authorized to execute and attest the vacation of a portion of the right of way known as Dooley Street as set forth in this Ordinance; and

 

3. That a certified copy of this vacation ordinance shall be recorded in the Office of the Clerk of the Circuit Court for the City of Hampton, Virginia in the manner as deeds are recorded and indexed in the name of the City of Hampton.

 

Adopted at the regular meeting of the City Council of the City of Hampton, Virginia held on October 14, 2015.
