An Ordinance to amend and re-enact
Section 2-311, Article XIII, of the Code of the City of Hampton, Virginia by creating a new Article XIII titled Fort Monroe Federal Area Development
BE IT ORDAINED by the
Council of the City of Hampton, Virginia that the Code of the City of Hampton,
Virginia, be amended and re-enacted as follows:
ARTICLE XIII. FORT MONROE FEDERAL AREA DEVELOPMENT AUTHORITY
Sec.2-311. Created; composition; powers and duties; etc.
Council of the City of Hampton, Virginia (the City Council) has determined
that it is advisable to provide for the creation of the Fort Monroe Federal
Area Development Authority (Fort Monroe FADA) pursuant to the emergency
legislation enacted by the Virginia General Assembly under the Authorities for
Development of Former Federal Areas Act, Chapter 63, Title 15.2 of the Code of
Virginia of 1950, as amended (the Act);
WHEREAS, a public hearing has been held on March 28, 2007, by the City Council on
the adoption of this Ordinance pursuant to the Act;

Monroe FADA in accordance with the State emergency legislation and in order to
enable more efficient cooperation with the federal government and the
Commonwealth of Virginia with respect to the reuse and planning of the military
installation in the City of Hampton, Virginia (the City) known as Fort

NOW THEREFORE, BE IT RESOLVED BY THE CITY

commissioners. The Fort Monroe FADA
shall be governed by a board of commissioners of eighteen (18) members to be
appointed as set forth in the Act. However, seven (7) such members shall be non-legislative
members and residents of the City appointed by the City Council. The members appointed
by the City Council shall serve for terms of not more than four (4) years each.
All other members shall serve as set forth in the Act.
