An Ordinance to Amend and Re-enact Chapter 37, "Taxation", Article II, "Real Estate Taxes", Division I, Section 37-18, "Board of Review of Assessments -Established; Composition; Appointment, Qualifications and Terms of Members" To Specify Nature of Real Property Ownership Requirement For Members, and Make Clerical Change.

 

 

BE IT ORDAINED by the City Council of Hampton, Virginia, that the Code of the City of Hampton, Virginia, be amended and re-enacted to read as follows:

 

Sec. 37-18. - Board of review of assessmentsEstablished; composition; appointment, qualifications and terms of members.

(a) For the purposes of this division, a real estate professional is defined to include a commercial or residential real estate appraiser, other real estate professional, builder, developer, or legal or financial professional.

 

(b) There is hereby established a board of review of real estate assessments, which shall be composed of five (5) members who shall be appointed by the city council. All members of such board shall be residents of the city and all shall own an interest in real property in fee within the city whether directly in their individual capacities or indirectly as holders of a greater than fifty (50) percent equity interest in a business entity duly authorized to do business in Virginia or beneficial interest in real property held in trust. At least thirty (30) percent of the members of the board shall be real estate professionals. No person assigned to the office of the assessor of real estate shall serve as a member of such board.

 

(c) In order to be eligible for appointment, each prospective member of such board shall attend and participate in the basic courses of instruction given by the Department of Taxation under 58.1-206 of the Code of Virginia. In addition, annually, each member shall take continuing education instruction provided by the tax commissioner pursuant to Virginia Code 58.1-206.

 

(d) The members of the board of review of real estate assessments shall be appointed for terms of four (4) years; provided, that the council may appoint or reappoint members for lesser terms in order that the term of one (1) member of the board shall expire each year. All vacancies shall be filled by the council for the unexpired term. No member shall serve for more than nine (9) consecutive years and upon the expiration of such nine (9) consecutive years such person shall not be eligible for reappointment for a period of three (3) years.
