Sec. 17-16. Designated.

 

The law library for the support of which the fund created by the imposition and assessment of costs under section 17-17 was created is hereby designated as "The George Wythe Law Library."

Sec. 17-17. Assessment of additional court costs in civil actions for support of library.

 

(a) Pursuant to section 42.1-70 of the Code of Virginia, there is hereby imposed and assessed, as part of the costs incident to each civil action filed in any court located within the city, the sum of two dollars ($2.00) for the support of the library referred to in section 17-16.

 

(b) The assessment provided for in this section shall be in addition to all other costs prescribed by law, but shall not apply to civil actions in which the state, or any other political subdivision thereof, or the federal government is a party and in which the costs are assessed against the state, or a political subdivision thereof, or the federal government.

Sec. 17-18. Collection, remittance and disbursement of assessments imposed by section 17-17.

 

The assessment imposed by section 17-17 shall be collected by the clerk of the court wherein the civil action is filed, except that, where a civil action is instituted by a civil warrant issued by a magistrate, then the magistrate shall collect the assessment and pay same to the clerk of the court in which the action is to be heard. All such assessments shall be remitted to the city treasurer and held by him, subject to disbursements by the city council, as a fund for the acquisition of law books and law periodicals and computer legal research services and equipment, and maintenance of the George Wythe Law Library, including compensation to be paid to librarians and other necessary staff for the maintenance of such library and acquisition of suitable quarters for such library.

Sec. 17-19. Acceptance of contributions from bar associations.

 

The city council may accept contributions to the fund created by the imposition and assessment of costs under section 17-17 from any bar association.

Sec. 17-20. Appointment and compensation of librarian.

 

The city council shall appoint a librarian of the George Wythe Law Library at such salary as shall be established by the council, from year to year, all to be paid out of the fund created by the imposition and assessment of costs under section 17-17.
