Ordinance to Approve a Memorandum of Understanding Between the Cities of Hampton and Poquoson to Fund and Maintain a Staff Position to Assist in a Joint Coastal Resiliency Initiative and to Authorize Execution and Delivery of Same.

 

WHEREAS, the cities of Hampton and Poquoson (the Localities) are committed to seeking a regional approach to increasing coastal flooding;

 

WHEREAS, the Localities have identified the necessity of employing an expert who can assist he Localities in addressing coastal resiliency planning, grant solicitation and implementation needs (the Coastal Resiliency Initiative);

 

WHEREAS, the Localities desire to share in the funding and maintenance of a staff position to assist with the Coastal Resiliency Initiative and to that end the Hampton City Manager recommended and the Council of the City of Hampton adopted FY 2016 Budget to include funding for a regional partnership with the City of Poquoson for the Coastal Resiliency Initiative;

 

WHEREAS, Virginia Code 15.2-1300 (Joint Powers Act) expressly provides that any two or more political subdivisions may enter into agreements with one another for joint action pursuant to the provisions of the Joint Powers Act and accordingly may contract with each other for the performance of governmental functions and for the joint use of facilities or services for the promotion and protection of the health and welfare of the citizens and for the mutual benefit of the Localities;

 

WHEREAS, designated staff members of the Localities have negotiated a mutually beneficial agreement (Memorandum of Understanding) pursuant to the Joint Powers Act to fund and maintain a staff position to assist in the Coastal Resiliency Initiative; and

 

WHEREAS, the Council of the City of Hampton, Virginia has determined that (i) the terms of the Memorandum of Understanding are acceptable; (ii) the pooling of resources to fund and maintain a staff position for the Coastal Resiliency Initiative will be more cost efficient; and (iii) approval of the Memorandum of Understanding attached to this Ordinance is in the best interest of the public health, safety and welfare of its citizens.

 

NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of Hampton, Virginia, as follows:

1. That it approves the Memorandum of Understanding with the city of Poquoson; and

2. That the City Manager or her authorized Designee is hereby authorized to execute and deliver the Memorandum of Understanding attached to this Ordinance to the appropriate parties.
