IN GENERAL

 

Sec. 12-1. Precincts and voting places generally.

 

The election precincts and voting places in the city shall be in accordance with the provisions of this chapter.

Sec. 12-2. Central absentee voter election district.

 

Pursuant to authority vested in the city council by section 24.2-712 of the Code of Virginia, there is hereby established a central absentee voter precinct for the city, for the purpose of counting and recording absentee ballots in all elections, both general and special. The polling place shall be located in the Circuit Court Building located at 101 King's Way, Hampton, Virginia.

PRECINCT BOUNDARIES

 

Sec. 12-21. Wythe precinct.

 

The Wythe precinct shall be composed of all the territory situate within the following described boundaries: Commencing at the point where the Hampton-Newport News City Limits Line touches the waters of Hampton Roads; running thence in a northerly direction along the Hampton-Newport News City Limits Line to the point of intersection with Hampton Avenue; running thence in an easterly direction along the centerline of Hampton Avenue to the point of intersection with Claremont Avenue; running thence in a northerly direction along the centerline of Claremont Avenue to the point of intersection with Kecoughtan Road; running thence in an easterly direction along the centerline of Kecoughtan Road to the point of intersection with a branch of a tributary of Indian River between Pochin Place and Little Farms Avenue; meandering thence in a northeasterly direction along such tributary to the point of intersection with Victoria Boulevard; running thence in an easterly direction along the centerline of Victoria Boulevard to the point of intersection with Hampton Roads Avenue; running thence in a southerly direction along the centerline of Hampton Roads Avenue to the point of intersection with Chesapeake Avenue; running thence in a westerly direction along the centerline of Chesapeake Avenue to the point of intersection with Powhatan Parkway; running thence in a southerly direction along the centerline of Powhatan Parkway to the point of intersection with Maynard Street; running thence in a southwesterly direction along the centerline of Maynard Street extended to the point of intersection with the waters of Hampton Roads, meandering thence in a westerly direction along the waters of Hampton Roads to the point of intersection with the Hampton-Newport News City Limits Line, the point or place of beginning.

The Armstrong precinct shall be composed of all the territory situate within the following described boundaries: Commencing at a point where the centerline of Maynard Street touches the waters of Hampton Roads; running thence in a northeasterly direction along the centerline of Maynard Street to the point of intersection with Chesapeake Avenue; running thence in an easterly direction along the centerline of Chesapeake Avenue to the point of intersection with Hampton Roads Avenue; running thence in a northerly direction along the centerline of Hampton Roads Avenue to the point of intersection with Victoria Boulevard; running thence in a northeasterly direction along the centerline of Victoria Boulevard to the point of intersection with Ivy Home Road; running thence in a southerly and easterly direction along the centerline of Ivy Home Road extended to the point of intersection with the waters of the Hampton River; meandering thence in a southerly direction along the waters of the Hampton River to the point of intersection with the waters of Hampton Roads; meandering thence in a westerly direction along the waters of Hampton Roads to the point of intersection with the extension of Maynard Street, the point or place of beginning.

The Phenix precinct shall be composed of all the territory situate within the following described boundaries: Commencing at the point of intersection of the Hampton-Newport News City Limits Line and Hampton Avenue; running thence in a northerly direction along the Hampton-Newport News City Limits Line and meandering in a westerly and southerly direction, and meandering thence in a westerly and northerly direction to the point of intersection with West Pembroke Avenue; running thence in a northeasterly direction along the centerline of West Pembroke Avenue to the point of intersection Aberdeen Road; running thence in a northerly direction along the centerline of Aberdeen Road to the point of intersection with Interstate 664; running thence in a northeasterly direction along the centerline of Interstate 664 to the point of intersection with an extension of "G" Street; running thence in a southeasterly direction along the centerline of "G" Street to the point of intersection with West Pembroke Avenue; running thence in a northeasterly direction along the centerline of Pembroke Avenue to the point of intersection with Powhatan Parkway; running thence in a southeasterly direction along the centerline of Powhatan Parkway to the point of intersection with Shell Road; running thence in a northeasterly direction along the centerline of Shell Road to the point of intersection with Hampton Roads Avenue; running thence in a southerly direction along the centerline of Hampton Roads Avenue to the point of intersection with Victoria Boulevard; running thence in a southwesterly direction along the centerline of Victoria Boulevard to the point of intersection with a branch of a tributary of Indian River between Pochin Place and Little Farms Avenue; meandering thence in a southeasterly direction along such tributary to the point of intersection with Kecoughtan Road; running thence in a southwesterly direction along the centerline of Kecoughtan Road to the point of intersection with Claremont Avenue; running thence in a southerly direction along the centerline of Claremont Avenue to the point of intersection with Hampton Avenue; running thence in a westerly direction along the centerline of Hampton Avenue to the point of intersection with the Hampton-Newport News City Limits Line, the point or place of beginning.

The Bassette precinct shall be composed of all the territory situate within the following described boundaries: Commencing at the point where the centerline of Victoria Boulevard intersects the centerline of Hampton Roads Avenue; running thence in a northerly direction along the centerline of Hampton Roads Avenue to the point of intersection with Shell Road; running thence in a westerly direction along the centerline of Shell Road to the point of intersection with Powhatan Parkway; running thence in a northwesterly direction along the centerline of Powhatan Parkway to the point of intersection with West Pembroke Avenue; running thence in a southwesterly direction along the centerline of West Pembroke Avenue to the point of intersection with "G" Street; running thence in a northerly direction along an extension of the centerline of "G" Street to the point of intersection with Interstate 664; running thence in a northeasterly direction along the centerline of Interstate 664 to the point of intersection with West Queen Street; running thence in an easterly direction along the centerline of West Queen Street to the point of intersection with West Pembroke Avenue; continuing thence in an easterly direction along the centerline of Settlers Landing Road to the point of intersection with LaSalle Avenue; running thence in a southerly direction along the centerline of LaSalle Avenue to the point of intersection with Victoria Boulevard; running thence in a southwesterly direction along the centerline of Victoria Boulevard to the point of intersection with Hampton Roads Avenue, the point or place of beginning.

The Lindsay precinct shall be composed of all the territory situate within the following described boundaries: Commencing at the point where the Hampton-Newport News City Limits Line intersects the centerline of West Pembroke Avenue; running thence in a northwesterly direction along the Hampton-Newport News City Limits Line to the point of intersection with Briarfield Road; running thence in an easterly direction along the centerline of Briarfield Road to the point of intersection with Aberdeen Road; running thence in a northerly direction along the centerline of Aberdeen Road to the point of intersection with Newmarket Creek; meandering thence in an easterly direction along the waters of Newmarket Creek to the point of intersection with Interstate 664; running thence in a southwesterly direction along the centerline of Interstate 664 to the point of intersection with Aberdeen Road; running thence in a southerly direction along the centerline of Aberdeen Road to the point of intersection with West Pembroke Avenue; running thence in a westerly direction along the centerline of West Pembroke Avenue to the point of intersection with the Hampton-Newport News City Limits Line, the point or place of beginning.

The Mallory precinct shall be composed of all the territory situate within the following described boundaries: Commencing at the point where the centerline of Martha Lee Drive intersects the centerline of West Mercury Boulevard; running thence in a easterly direction along West Mercury Boulevard to the point of intersection with Pennwood Drive; running thence in a southerly direction along the centerline of Pennwood Drive to the point of intersection with West Weaver Road; running thence in an easterly direction along the centerline of West Weaver Road to the point of intersection with Aberdeen Road; thence running in a southerly direction along the centerline of Aberdeen Road to the point of intersection with Briarfield Road; running thence in a westerly direction then southwesterly along the centerline of Briarfield Road to the point of intersection with the Hampton-Newport News City Limits Line; running thence in a northwesterly direction along the Hampton-Newport News City Limits Line to the point of intersection with West Weaver Road; running thence in an easterly direction along the centerline of West Weaver Road to the point of intersection with Martha Lee Drive; running thence in a northwesterly direction along the centerline of Martha Lee Drive to the point of intersection with West Mercury Boulevard, the point or place of beginning.

SCHOOL BOARD

 

Sec. 12-91. Voting districts for school board members.

 

There shall be seven (7) members of the school board. One (1) member shall be elected at large by all the voters of the City of Hampton and shall represent all areas of the city. In addition, the City of Hampton shall be divided into two (2) school board voting districts, each of which shall be entitled to elect three (3) members of the school board. Each member shall hold a designated seat within the district (seats shall be designated as seats A, B and C). The voting districts are described and shown on that certain map entitled, "City of Hampton, Virginia School Board Voting Districts", dated February 9, 1994, and prepared by the Hampton Planning Department, which is hereby adopted by reference. The boundaries of the respective school board voting districts according to said map are set forth as follows:

 

(1) Hampton Roads Voting District. The Hampton Roads Voting District shall be described as follows: Beginning at the intersection of the Hampton/Newport News city line and West Weaver Road and traveling east along the centerline of West Weaver Road to its intersection with Martha Lee Drive, then northwesterly along the centerline of Martha Lee Drive to its intersection with West Mercury Boulevard, then east along the centerline of West Mercury Boulevard to its intersection with Pennwood Drive, then north along the centerline of Pennwood Drive to its intersection with Butternut Drive, then east along the centerline of Butternut Drive to its intersection with Gumwood Drive, then south along the centerline of Gumwood Drive to its intersection with West Mercury Boulevard, then east along the centerline of West Mercury Boulevard to its intersection with Interstate 64, then northwest along the centerline of Interstate 64 to its intersection with Magruder Boulevard, then north along the centerline of Magruder Boulevard to its intersection with Nettles Lane, then east along the centerline of Nettles Lane to its intersection with North Armistead Avenue, then south along the centerline of North Armistead Avenue to its intersection with West Mercury Boulevard, then east along the centerline of West Mercury Boulevard to its intersection with North King Street, then north along the centerline of North King Street to its intersection with Old Fox Hill Road, then east along the centerline of Old Fox Hill Road to its intersection with Fox Hill Road, then northeast along the centerline of Fox Hill Road to its intersection with Old Buckroe Road, then south along the centerline of Old Buckroe Road to its intersection with Andrews Boulevard, then west along the centerline of Andrews Boulevard to its intersection with Boykin Lane, then south along the centerline of Boykin Lane to its intersection with Old Buckroe Road, then southwest along the centerline of Old Buckroe Road to its intersection with Atlantic Avenue, then southeast along the centerline of Atlantic Avenue to its intersection with East Pembroke Avenue, then southwest along the centerline of East Pembroke Avenue to its intersection with Old Buckroe Road, then southwest along the centerline of Old Buckroe Road to its intersection with West Sherwood Avenue, then southeast along the centerline of West Sherwood Avenue to its intersection with East Sherwood Avenue, then southeast along the centerline of East Sherwood Avenue to its intersection with Perry Street, then northeast along the centerline of Perry Street to its intersection with Weber Lane, then south along the centerline of Weber Lane extended to the point of intersection with the waters of Mill Creek, then southwesterly along the waters of Mill Creek to its intersection with the waters of the Chesapeake Bay, then westerly along the waters of the Chesapeake Bay to its intersection with the waters of the Hampton Roads, continuing west along the waters of Hampton Roads to the Hampton/Newport News City Line, then north along the Hampton/Newport News City Line back to the point of origin.

 

(2) Chesapeake Bay Voting District. Sec. 12-92. Election and terms of members of the school board.

 

There shall be a general election of the school board on the first Tuesday in May, 1994, or as soon thereafter as may be permitted or provided by law, at which time there shall be elected three (3) members. Those three (3) members shall be elected by the qualified voters of the various school board voting districts as follows: Two (2) from the Hampton Roads Voting Districts (seats A and B) and one (1) from the Chesapeake Bay Voting District (seat A). Only those qualified voters residing in each voting district shall be eligible to vote for the school board member representing that specific district. The candidate receiving the highest number of votes in each individual voting district with respect to the designated seat up for election shall be declared elected to that seat and shall serve four (4) years.

 

The three (3) members so elected shall take office on July 1, 1994, or as soon thereafter as is permitted by law. The remaining four (4) members of the school board who have been previously and legally appointed to the board by the city council shall continue to serve as members of the school board until June 30, 1996, or until such time as their successors have been duly elected.

 

There shall be a general election for the school board on the first. Tuesday in May, 1996, at which time there shall be elected four (4) members. These four (4) members shall be elected by the qualified voters of the various school board voting districts as follows: One (1) from the Hampton Roads Voting District (seat C) and two (2) from the Chesapeake Bay Voting District (seats B and C) and one (1) from the city at large. Only those qualified voters residing in each voting district shall be eligible to vote for candidates for the school board representing that specific district, and each qualified voter of the city shall be eligible to vote for the candidate for the at-large position. The candidate receiving the highest number of votes in each individual voting district with respect to the designated seat (or in the city for the at-large position) shall be declared elected and shall serve four (4) years. The four (4) members so elected shall take office on July 1, 1996.

 

Thereafter there shall be a general election every two (2) years, held on the first Tuesday of May, with candidates receiving the highest number of votes in each respective voting district for each designated seat (or at large) being declared elected and with terms of school board members elected at such elections beginning July 1, following their election and continuing for four (4) years.

 

The school board shall be a continuing body and no measure pending before it shall abate or be discontinued by reason of the expiration of the term of office or the removal of the members of the body or any of them.

Sec. 12-93. Nomination of candidates for members of the school board.

 

Candidates for member of the school board shall be qualified voters of city and residents of the election district through which they seek office. Candidates shall file their notice of candidacy and be nominated only by petition in the manner prescribed by law for non-party candidates and not by caucus, primary, convention or other party-affiliated preceding.

Sec. 12-94. Party designation and ballots in school board elections.

 

The ballot used in the election of members of the school board shall be without any distinguishing party name, mark or symbol.

Sec. 12-95. Selection of chairperson.

 

The chairperson of the elected school board shall be selected by the members of the school board from the members of the school board at the board's annual meeting.
