Proposed acquisition of property, known as 31 Freeman Drive (4 acres) RPC No. 7000125 & 10 acres off Freeman Drive RPC No. 7000130 (the Prince Property), from Frances Prince Irick, formerly known as Frances V. Prince, sole heir of Louis F. Prince, III, deceased.

 

A Resolution authorizing the City Manager to proceed with the acquisition of property known as 31 Freeman Drive from Frances Prince Irick, formerly known as Frances V. Prince, sole heir of Louis F. Prince, III, deceased, for a public purpose.

 

WHEREAS, staff negotiated a contract for the City to purchase two parcels of real property totaling approximately 14 acres located in the Crossroads area of the Coliseum Central District of Hampton (the Prince Property) from Frances Prince Irick, formerly known as Frances V. Prince, sole heir of Louis F. Prince, III, deceased, for $1,050,772.00 (the Purchase Price);

 

WHEREAS, the Prince Property is being acquired as part of the Newmarket Creek Park and Trail System and the Freeman Drive Realignment as shown in the Newmarket Creek Park and Trail System Plan;

 

WHEREAS, the Purchase Price is deemed fair and reasonable, the Purchase Agreement that is attached to this Resolution sets forth reasonable and acceptable terms, and funding to acquire the Prince Property, including all acquisition costs in the total amount of $1,070,772 as set forth in Exhibit A attached hereto, will come from the transfer of the H2O proceeds from the Hampton Redevelopment and Housing Authority (HRHA) to the Citys Capital Projects Fund; and

 

WHEREAS, the purchase of the Property is strategic for assemblage and development of the Newmarket Creek Park and Trail System in accordance with the 2004 Coliseum Central Master Plan, as amended and is manifestly in the publics interest.

NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Hampton, Virginia, as follows:

 

1. That the City Manager or his designee is hereby authorized and directed to proceed with the acquisition of the Prince Property for a public purpose by negotiation or condemnation; and

 

2. That the Purchase Agreement with Frances Prince Irick, formerly known as Frances V. Prince, sole heir of Louis F. Prince, III, deceased, in substantially the form attached to this Resolution, is approved with such modifications as the City Manager or his designee, on the advice of counsel, believes to be in the interest of the City, together with the execution of any and all necessary legal documents to effectuate the transfer of title; such documents shall include, but not be limited to, contracts, deeds, easements, releases for sale and transfer, and conveyance of the Prince Property.

 

Adopted at the regular meeting of the City Council of the City of Hampton, Virginia held on April 25, 2007.
