Resolution Authorizing the City Manager to acquire easements for drainage, sanitary sewer and utilities from property owners for mutual benefits to permit the City to construct small neighborhood projects.

 

RESOLUTION

WHEREAS, the City of Hampton through its Department of Public Works from time to time finds it necessary to acquire easements for drainage, sanitary sewer and utilities from private property owners in order to provide these services to its citizens; and

WHEREAS, the property owners are willing to grant the easements to the City of Hampton based upon the mutual benefits which are to accrue to the parties; and

WHEREAS, the acquisitions involve a small number of parcels and are frequently the result of a particular neighborhood need or request; and

WHEREAS, the benefits for the property owners include improved drainage facilities and access to sanitary sewer and utility service; and

WHEREAS, the benefits for the City include better drainage infrastructure and a more complete and comprehensive system of sanitary sewer and utilities which enhances the public health, safety and welfare of the citizen of Hampton; and

WHEREAS, the City Manager acting through the Department of Public Works has requested that he be authorized to acquire easements for drainage, sanitary sewer and utilities for mutual benefits from property owners within the City of Hampton, when acquisition of such easements will permit the Department to construct these small, neighborhood projects.

NOW THEREFORE BE IT RESOLVED, by the Council of the City of Hampton, VA that the City Manager is authorized to acquire easements for drainage, sanitary sewer and utilities from property owners for mutual benefits to permit the City to construct small neighborhood projects which will promote the public health, safety and welfare.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HAMPTON, VIRGINIA that the City Manager is authorized to accept the deeds of easement on behalf of the City.
