Ordinance Authorizing the Conveyance of Property in Buckroe by the City of Hampton to POH 2010, LLC

 

 

 

WHEREAS, the City of Hampton (City) owns four (4) parcels of real property in the Buckroe Beach area totaling 172,622 square feet (3.96 acres) (the Property) bounded by 2nd Street, Point Comfort Avenue, North Mallory Street and Pembroke Avenue shown as Parcel Two on the map attached and labeled Parcel Two to be Conveyed to POH 2010, LLC;

WHEREAS, POH 2010, LLC , one of two successful respondents to the Citys request for proposals for the Buckroe Beach area redevelopment, will develop a residential project in two phases with the first phase consisting of a Parade of Homes developed in conjunction with the Peninsula Housing & Builders Association, featuring seven (7) single-family homes, two (2) mansion style homes (each containing four (4) residential units) and two (2) mansion style homes (each containing (3) residential units) on one-half of the block on the corner bordering Pembroke Avenue and 2nd Street, and completed no later than on or before May 6, 2010 but no later than June 30, 2010 and the second phase consisting of five (5) single family homes, two (2) additional 4-unit mansion style homes and two (2) additional 3-unit mansion style homes to be constructed by the builders who participated in the Parade of Homes (or their assigns) and completed no later than June 30, 2012 (the Project);

WHEREAS, consistent with the 2005 Buckroe Master Plan, as amended, the City desires to convey the four parcels generally described above to POH 2010, LLC for redevelopment in accordance with the 2005 Buckroe Master Plan, as amended, the 2007 Buckroe Bayfront Pattern Book, the SPI-BBD zoning regulations and the Development Agreement between the City of Hampton and POH 2010, LLC; and

WHEREAS, the Council has determined that the POH 2010, LLC Project will increase tax revenues, improve the image and economic vitality of Buckroe and stimulate its redevelopment, and is therefore in the best interest of the citizens of the City of Hampton.

NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of Hampton, Virginia, as follows:

1. That it approves the conveyance to POH 2010, LLC of the four parcels of land located in the City of Hampton in the Buckroe Beach area and generally described above in accordance with the 2005 Buckroe Master Plan, as amended, for redevelopment in accordance with the 2005 Buckroe Master Plan, as amended, the 2007 Buckroe Bayfront Pattern Book, the SPI-BBD zoning regulations, and the Development Agreement between the City and POH 2010, LLC; and

2. That the City Manager or his authorized designee and the Clerk be and are authorized to execute and deliver to POH 2010, LLC any and all necessary legal documents to effectuate the transfer; such documents shall include, but not be limited to, contracts, deeds, releases for sale and transfer, and conveyance of the four parcels generally described above in the Buckroe Beach area of the City of Hampton, Virginia.

The Ordinance requires an affirmative vote of three-fourths of all of the members elected to Council
