Resolution Authorizing the Acceptance of Certain Fire Suppression Equipment as Donated by the Virginia Department of Transportation

 

WHEREAS, the Virginia Department of Transportation Central Office Operations and Security Division (Virginia Department of Transportation) has purchased certain fire suppression equipment, specifically, the Rechners LUF-60 Fire Suppression Equipment (fire suppression equipment), to support the response of firefighters to fires in tunnels; and

 

WHEREAS, the Virginia Department of Transportation desires to donate and transfer ownership of said fire suppression equipment to the City of Hampton for use by its Division of Fire and Rescue at no cost to the City of Hampton; and

 

WHEREAS, the Virginia Department of Transportation agrees to transfer all rights, titles, interest and ownership of said fire suppression equipment to the City of Hampton subject to the following conditions:

 

1.      To use the equipment to augment its firefighting and emergency response resources during a mass casualty, disaster or terrorism event;

2.      To honor mutual aid requests for the equipment from other jurisdictions and organizations during mass casualty events that exceed the resources of the requesting party as permitted by existing mutual aid agreements and availability;

3.      To provide proper storage and reasonable maintenance, repair and use to maintain operational condition of the equipment;

4.      To take possession of the equipment on an as is basis without any representation or warranties, express or implied, and with the understanding that the Virginia Department of Transportation shall have no remaining obligations or liabilities with respect to the equipment; and

5.      To take official ownership of the equipment on an agreed upon date by accepting delivery of the equipment and indicating receipt of the equipment on the vendors bill of lading.

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Hampton, Virginia, that donation of the Rechners LUF-60 Fire Suppression Equipment is hereby authorized and accepted pursuant to the conditions set forth above.

 

Adopted at the regular meeting of the City Council of the City of Hampton, Virginia held on February 14, 2007.
