Ordinance to Amend and Reenact Chapter 21, "Motor Vehicles and Traffic", Article I, "In General", of the City Code of the City of Hampton, Virginia, by Amending Section 2-18, "Use of Video-Monitoring Systems to Enforce Law Against Passing Stopped School Buses Authorized."

 

 

BE IT ORDAINED by the Council of the City of Hampton, Virginia, that Chapter 21, of the City Code of the City of Hampton, amended and reenacted to read as follows:

 

Sec. 21-18. - Use of video-monitoring systems to enforce law against passing stopped school buses authorized.

(a) The School Board of the City of Hampton is hereby authorized to install and operate a video-monitoring system in or on school buses operated by the school division, or to contract with a private vendor to do so on behalf of the school division, for the purpose of recording violations of 46.2-844 of the Code of Virginia prohibiting drivers of motor vehicles from passing stopped buses under the conditions set forth in this statute. Section 46.2-844 of the Code of Virginia has been duly incorporated by reference into the Code of the City of Hampton, 21-1, pursuant to authority granted in 46.2-1313 of the Code of Virginia.

 

(b) The term "video-monitoring system" shall have the meaning given it in 46.2-844(B) of the Code of Virginia. Any such system, and the operation thereof, shall comply with all requirements of "video-monitoring systems" contained in 46.2-844(B) of the Code of Virginia.

 

(c) Any civil penalty levied for a violation of Virginia Code 46.2-844 as incorporated by reference into the Code of the City of Hampton by 21-1, shall be payable to the School Board for the City of Hampton.
