Ordinance Approving the Vacation of the 30-Foot Right of Way, 3,250 Square Feet, More or Less, Located at the Southern End of Resort Boulevard

 

WHEREAS, as part of a future rerouting project, City staff requests the vacation of a 30-foot right of way, 3,250 square feet, more or less, located at the southern end of Resort Boulevard and known as Extension of the Boulevard;

 

WHEREAS, the 30-foot right of way sought to be vacated was platted in 1934 to allow public access to what was then or subsequently known as the Buckroe Beach Fishing Pier;

 

WHEREAS, the extension of Resort Boulevard has been rerouted as depicted on the attached plat to eventually align with Bay Shore Drive; therefore, the former right of way is no longer necessary;

 

WHEREAS, the 30-foot right of way straddles two properties LRSNs 13001556 and 13001557 -- both owned by the City;

 

WHEREAS, City staff and local public utility companies have reviewed this request; upon receiving no objections, staff recommends approval; and

 

WHEREAS, pursuant to Virginia Code 15.2-2006, the Council agrees to vacate the 30-foot right of way located at the southern end of Resort Boulevard.

 

NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of Hampton, Virginia, as follows:

 

1. That the vacation of the 30-foot right of way known as Extension of the Boulevard at the southern end of Resort Boulevard is hereby approved; and

 

2. That the City Manager, or her authorized designee, and Clerk of Council are hereby authorized to execute and attest the vacation of the 30-foot right of way as set forth in this Ordinance.

 

Adopted at the regular meeting of the City Council of the City of Hampton, Virginia, held on the 8th day of January, 2014.
