Resolution authorizing the conveyance of a small parcel of land on Grant Circle to William D. Solterbeck and Amparito Solterbeck

 

 

WHEREAS, the City of Hampton, Virginia is the owner of a small parcel of land on the southwest side of Grant Circle adjacent to the property at 384 Grant Circle; and

WHEREAS, William D. and Amparito Solterbeck, husband and wife (hereinafter referred to as the Solterbecks) are the owners of the property at 384 Grant Circle in Hampton, Virginia; and

WHEREAS, the Hampton Redevelopment and Housing Authority (hereinafter referred to as HRHA) owns a parcel of land to the south or rear of the Solterbeck property on which it has developed several housing units; and

WHEREAS, the gravel driveway that accesses the housing units owned by the HRHA

crosses a portion of the Solterbeck property; and

WHEREAS, the Solterbecks have agreed to convey this small parcel of land containing approximately 186 square feet to the HRHA to improve access to the housing units owned by the HRHA; and

WHEREAS, the Solterbecks have requested that the City convey to them a small parcel of land to the east of their property, containing approximately 551 square feet, which would enable the Solterbecks to maintain their existing chain link fence; and

WHEREAS, the HRHA is willing to accept the conveyance of the property from the Solterbecks; and

WHEREAS, the Solterbecks are willing to convey the property to the HRHA in exchange for the Citys agreement to convey the 551 square feet to them; and

WHEREAS, the exchange of these parcels would be in the public interest and improve access to the housing units owned by the HRHA.

NOW, THEREFORE, BE IT RESOLVED that the Council for the City of Hampton, Virginia, does hereby authorize and approve the conveyance to William D. Solterbeck and Amparito Solterbeck, husband and wife, a small parcel of land located to the southwest of Grant Circle containing approximately 551 square feet, which parcel is adjacent to and east of the Solterbeck property located at 384 Grant Circle and to the north of the property of the HRHA and that said conveyance will be conditioned upon the conveyance by the Solterbecks of a small parcel containing approximately 186 square feet to the Hampton Redevelopment and Housing Authority.

NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council does hereby authorize the Mayor or the Vice-Mayor to execute on behalf of the City of Hampton, Virginia, any and all documents including appropriate deeds to conveyance for the aforesaid piece of real property to the Solterbecks.

NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council that the documents necessary to effectuate the transfer of the above-described parcel, including, but not limited to contracts, deeds, releases for sale and transfer, and the conveyance of the parcel described above shall be in a form that substantially comply with the terms of this Resolution, the terms of which are hereby approved with such completions, omissions, insertions, and changes that may be approved by the officers executing said documents, that the officers

execution of such documents shall constitute exclusive evidence of the officers approval of such completion, omission, insertion, and change.
