Resolution Determining Carter Machinery Company, Incorporated to be the Only Source Practicably Available from which to Procure Parts, Periodic Maintenance, and Repair Service for the Hampton Department of Public Works and Authorizing the Negotiation and Execution of a Purchase Contract with Carter Machinery Company, Incorporated.

 

 

 

WHEREAS the Hampton City Council recognizes the public interest in providing refuse management through Hamptons Steam Plant, a division of the Department of Public Works;

 

WHEREAS the Hampton City Council recognizes that the Steam Plant, as one of only five waste combustion facilities operating in the Commonwealth of Virginia, uses and maintains equipment which is unique;

WHEREAS the Steam Plant previously purchased Caterpillar equipment, and as a result needs Caterpillar parts, periodic repairs to the Caterpillar equipment, and corresponding preventative maintenance;

 

WHEREAS Carter Machinery is the exclusive provider of Caterpillar parts, and is the exclusive local entity capable of performing the necessary servicing;

 

WHEREAS other local vendors have the ability to lubricate Caterpillar equipment, but cannot provide parts and services;

 

WHEREAS Carter Machinery Company, Incorporated has offered a reasonable price for parts, repairs and maintenance;

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Hampton, Virginia as follows:

 

1. That the contract for procuring the parts, repairs, and maintenance described above may be negotiated and awarded to Carter Machinery Company, Incorporated as a sole source without competitive sealed bidding or competitive negotiation as set forth in Virginia Code 2.2-4303(E);

 

2. That the City Manager or his authorized designee is hereby authorized to negotiate and execute a purchase contract with Carter Machinery Company, Incorporated; and

 

3. That the notice awarding the contract to Carter Machinery Company, Incorporated shall be posted in a public place pursuant to Virginia Code 2.2-4303(E).
