Approve a License Agreement along
Aluminum Avenue for the installation of an underground conduit and fiber optic
cable for data transmission to warehouses operated by Newport News Shipbuilding
and Dry Dock Company on property located at 2220 and 2101 Aluminum Avenue.
WHEREAS, Newport News
Shipbuilding and Dry Dock Company, a Virginia corporation, (the Licensee),
owns 2220 Aluminum Avenue and leases 2101 Aluminum Avenue from BEH, LC, a
Virginia limited liability company, (the Property); and
WHEREAS, Licensee operates
business on the Property and desires to place or construct an underground 2
conduit and fiber optic cable in 24 license area for data transmission (the
Licensed Improvements) under/over the public right of way known as Aluminum
WHEREAS, Licensee has
requested that the City of Hampton grant it permission with an exclusive
license for the installation of the Licensed Improvements under/over the public
right-of-way known as Aluminum Avenue.
THEREFORE, BE IT RESOLVED by the Council of the City of Hampton, Virginia,
that it approves and grants an exclusive license to Newport News Shipbuilding
and Dry Dock Company, a Virginia corporation, for the installation of Licensed
Improvements under/over the public right of way known as Aluminum Avenue in the
location shown on Exhibit A designated as 2 Conduit Installed in 24
Right-of-Way, attached to the License Agreement.
NOW, THEREFORE, BE
IT FURTHER RESOLVED BY THE COUNCIL OF THE CITY OF HAMPTON, VIRGINIA that the Mayor is
authorized to sign the documents necessary to effectuate the License Agreement
under/over the public right-of-way known as Aluminum Avenue along with the
owners of the parcels of land known as 2220 and 2101 Aluminum Avenue, Hampton, Virginia.
