Resolution authorizing the execution of an Ingress/Egress Public Access Easement and Maintenance Agreement and an Ingress/Egress Vehicular and Parking Easement and Maintenance Agreement with Tysinger Real Estate, LLC.

 

RESOLUTION

WHEREAS, Tysinger Motors through its real estate holding company, Tysinger Real Estate, LLC (Tysinger) has acquired a 3.5 acre parcel of real property adjacent to the Hampton Roads Center Parkway in order to expand its car dealership;

WHEREAS, the proposed expansion is separated from the existing dealership by a City-owned parcel known as the Billy Wood Canal which conveys stormwater to the Back River from the area around Magruder Boulevard, and the site is limited further by the prohibition of direct access from Hampton Roads Center Parkway;

WHEREAS, the construction of a new bridge to cross the Billy Wood Canal would allow the expansion of the dealership to be effected; however, the access to and from the dealership and the expanded area will require the granting of public access, vehicular and parking easements by the City of Hampton (the City);

WHEREAS, staff and legal counsel for the City and Tysinger have negotiated easement and maintenance agreements attached hereto with terms and conditions that are mutually acceptable and protect the interests of the City; and

WHEREAS, the City would benefit from the expansion of the Tysinger dealership site in the form of real estate taxes and Tysinger's maintenance of a public amenity.

NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Hampton, Virginia that the City Manager is authorized to execute the Ingress/Egress Public Access Easement and Maintenance Agreement and the Ingress/Egress Vehicular and Parking Easement and Maintenance Agreement with Tysinger Real Estate, LLC in substantially the form attached to this Resolution, with such modifications as the City Manager or his designee, on the advice of the City Attorney, believes to be in the interest of the City.
