Resolution Authorizing the City Manager to Execute a Right of Way Agreement with Virginia Electric and Power Company for the Installation, Operation and Maintenance of Electric Power on its Property Located at 100 North Park Lane.

 

RESOLUTION

WHEREAS, the City of Hampton (the City) is the owner of certain real property located at 100 North Park Lane (the property) in the City of Hampton, also known as Bethel Landfill; and

WHEREAS, USA Waste of Virginia Landfills, Inc., (Waste Management), leases the property from the City and operates the landfill; and

WHEREAS, a new gas plant facility has been located on the property; and

WHEREAS, the City and Waste Management have requested Virginia Electric and Power Company, (Virginia Power) to install and operate wires and facilities for the transmission of electric power to and from the new gas plant facility; and

WHEREAS, the attached Agreement provides for the installation, operation and maintenance of Virginia Powers wires and facilities on the Citys property as more fully described in the Plat attached to the Agreement; and

WHEREAS, Waste Management has agreed to the terms of the Agreement.

NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Hampton, Virginia, as follows:

1.      That the City approves the terms of the Agreement attached hereto; and

2.      That the City Manager or his designee is hereby authorized to execute an Agreement with Virginia Power in substantially the form attached hereto.

Adopted at the regular meeting of the City Council of the City of Hampton, Virginia held on May 14, 2008.
