Resolution Authorizing the Disposal of Certain Surplus City Vehicles by Negotiated Trade-in for Replacement Vehicles

 

RESOLUTION

WHEREAS, Hampton City Council recognizes the public interest in providing flexibility in the methods of disposal of city-owned property that cannot be put to effective use, while at the same time ensuring compliance with the principles of competition set forth in state and city procurement laws in the disposal of such surplus property and the procurement of replacement property;

 

WHEREAS, Hampton City Code Section 2-338, Disposal of Surplus Property provides that the city manager or her designee(s) may dispose of such property by the methods described sections (1) and (2) thereof, or pursuant to other direction issued by formal vote of this Council (see ordinance provisions, attached);

 

WHEREAS, the City Manager advises that the Chief of Police has determined in his professional judgment that certain vehicles acquired by the Police Division in the course of a concluded undercover cigarette trafficking investigation may not be effectively used in other police operations, but retain significant value that may be applied in the procurement of other vehicles needed for Police Division operations, which value may not be realized in disposal by auction or competitive sealed bidding; and

 

WHEREAS, the City Manager further advises and this Council agrees, that it is likely more cost effective for the value of the surplus vehicles to be applied toward the purchase of additional vehicles by trade-in negotiation with vehicle dealers identified in a competitive process, and the Council supports giving the City Manager the flexibility to dispose of the surplus vehicles in this manner or by auction, in her discretion.

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Hampton, Virginia as follows:

 

1. That the manager is hereby authorized and directed to dispose of the surplus city vehicles described in this resolution and to procure replacement vehicles for use by the Police Division by negotiated trade-in with qualifying vehicle dealers selected pursuant to applicable procurement law requirements, or to dispose of the surplus vehicles by the methods set forth in Hampton City Code Section 2-338, Sections 1 and 2.
