ORDINANCE TO ESTABLISH A NO WAKE ZONE AT THE MOUTH OF BACK RIVER ADJACENT TO FACTORY POINT FROM DAY MARKER #4 TO 100 FEET NORTH OF DAY MARKER #2

 

WHEREAS, Factory Point in the City of Hampton is a very popular place for boaters and swimmers and is frequently the site of a significant number of recreational boats and people enjoying the beach and the water; and

 

WHEREAS, the channel exiting Back River is very close to shore especially in the area from Day Marker # 4 to approximately 100 feet North of Day Marker # 2; and

 

WHEREAS, vessels entering or exiting this channel must pass dangerously close to the moored vessels along the beach and to individuals playing at the waters edge; and

 

WHEREAS, the hazard at this location is amplified because the channel makes a sharp turn against the shore just past Day Marker # 2; and

 

WHEREAS, boaters frequently travel through this area at a high rate of speed; and

 

WHEREAS, because of the popularity of Factory Point, the large concentration of boaters and swimmers, the closeness of the channel to the shore, the sharp turn in the channel at Day Marker # 2, and the excessive speed of many of the boats there is created a hazardous condition which threatens the public safety by exposing swimmers, boaters and property to risk of severe injury; and

 

WHEREAS, the City is of the belief that the risk to public safety can be significantly decreased by the establishment of a No Wake Zone from Day Marker # 4 to approximately 100 feet North of Day Marker # 2, more particularly described as from N 37 06 23.8 W 076 17 37.4 in a northerly direction 100 feet past Day Marker # 2 to N 37 06 29.5 W 076 17 45.1.

 

NOW, THEREFORE, BE IT ORDAINED, by the Council of the Hampton, Virginia that it hereby approves the establishment of a No Wake Zone from N 37 06 23.8 W 076 17 37.4 in a northerly direction 100 feet past Day Marker # 2 to N 37 06 29.5 W 076 17 45.1 in the City of Hampton.

 

BE IT FURTHER ORDAINED that the Department of Game and Inland Fisheries be requested to authorize the installation of the No Wake Zone described above.

Adopted at the regular meeting of the City Council of the City of Hampton, Virginia held on January 9, 2008.
