A Resolution to Amend and Reenact the Self-Insurance Program of the City of Hampton, Virginia as it Pertains to Coverage for the School Board of the City of Hampton.

 

RESOLUTION

 

WHEREAS, the City of Hampton, Virginia, has established a self-insurance program to provide liability coverage in order to protect the assets of the City; and

 

WHEREAS, the City Council of the City of Hampton, Virginia, has previously resolved to provide protection for the School Board of the City of Hampton and it continues to be the policy of the City Council to provide such protection for the School Board of the City of Hampton and/or its members, employees, agents, volunteers and committee members against any liability arising from their conduct in the discharge of their official duties.

 

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Hampton, Virginia, does hereby agree to provide a limited amount of liability insurance coverage for the aforementioned parties with respect to claims for damages allegedly caused by their acts or omissions in the discharge of their official duties, while acting within the scope of their duties as such or on behalf of the School Board of the City of Hampton, Virginia, except for liabilities arising from criminal acts, willful misconduct or intentional torts. The City Council hereby authorizes the City Manager to provide such coverage under the self-insurance program established by the City to the extent the claims arising out of any one occurrence do not exceed the sum of one million dollars ($1,000,000.00).

 

BE IT FURTHER RESOLVED that the coverage afforded under the self-insurance program of the City of Hampton, Virginia will be applied to cover the costs and expenses incident to such liability, including those incurred in defending court actions, suits or proceedings brought against the aforementioned parties and for the settlement of claims and the satisfaction of judgments.

 

BE IT FURTHER RESOLVED that the City Council of the City of Hampton, Virginia, does hereby authorize the City Manager to provide additional protection from any claims that may be asserted against the School Board and/or any of the aforementioned parties by purchasing excess commercial liability insurance or through participation in a public entity self-insurance mechanism, whichever is deemed appropriate.

 

BE IT FURTHER RESOLVED that the City Council of the City of Hampton, Virginia, does not waive the sovereign immunity of the City or the School Board with respect to claims asserted by third parties except to the extent provided by statute and waives its sovereign immunity with respect to claims for liability coverage asserted by members of the School Board, its employees, agents, volunteers, and committee members only to the extent of the one million dollars ($1,000,000.00) in coverage to be provided under the Citys self-insurance program and the sum available under any excess coverage procured by the City Manager.
