AN ORDINANCE TO AMEND AND REENACT CHAPTER 21, ARTICLE VIII, ENTITLED, POLICE REQUESTED TOWING BY AMENDING SECTION 21-215, AND BY ADDING THERETO NEW SECTIONS 21-216 AND 21-217.

 

 

Sec. 21-215. Administration of tow list.

 

(a) The city manager or his designee shall maintain a list of tow operators who shall be called in sequence to provide services at the scene of accidents or traffic hazards or other such incidents. The list shall be utilized only in those cases where the owner or operator of a distressed motor vehicle does not, for any reason, provide the police officer in charge with the name of a tow operator available to perform the required services in a timely manner.

 

(b) The list of tow operators shall be maintained and administered by the city manager or his designee. The city manager or his designee may prescribe conditions for tow operators who apply to be included in the tow list, and he may also establish rules and regulations, which must be obeyed by tow operators who are listed. In promulgating such, rules and regulations, the city manager or his designee may address the following matters including but not limited to:

 

(1) Compliance with minimum safety standards.

 

(2) Ownership or possession of all equipment and facilities deemed necessary by the chief of police to provide essential services.

 

(3) Adherence to the fee schedule adopted by the city council as set forth below:

 

a. No hook up and initial towing fee shall exceed One Hundred Twenty Five Dollars ($125.00).

 

b. For towing a vehicle between 7:00 p.m. and 8:00 a.m. or on any Saturday, Sunday or holiday, an additional fee of ten dollars ($10.00) may be charged.

 

c. If a call requires more than one (1) tow vehicle, the fee per tow vehicle shall not exceed the single tow vehicle fees set out herein.

 

d. No other additional services may be charged other than those listed below with the maximum amount which may be charged:

 

Unusual Recovery Fee

$62.50 per hour.

 

Wait Time

$25.00 per 1/2 hour following the first hour after arrival.

Storage fee

$28.00 per day after 1st 24 hrs

Vehicle Title Processing Pursuant to Virginia Code Section 46.2-1202, et seq.

Reasonable Fee (Documentation Required)

Heavy Duty Tow Fee (gross weight exceeds 26,000 lbs.)

$285.00

 

 

(4) Maintaining of a business office accessible to patrons during reasonable business hours.

 

(5) Access to the tow lot or vehicle storage area.

 

(6) Keeping accurate and complete records of all transactions governed by this section.

 

(7) Maintaining proper custody of towed vehicles and their contents.

 

(8) Insurance requirements, operator license and business license requirements.

 

Sec. 21-216. Posting of allowable fees and services.

All persons engaged in police requested towing shall prominently display at their main place of business and any place where they may store vehicles as a result of a police requested tow a comprehensive list of the allowed fees for towing, recovery and storage services pursuant to Section 21-215.

Sec. 21-217. Violations.

 

Any person violating any provision of this chapter shall be guilty of a Class 3, misdemeanor and a Class 2, misdemeanor for subsequent convictions.
