Resolution Accepting a Donation of 24 Flagpoles, with Silks, from the Downtown Hampton Development Partnership to the City of Hampton, Virginia.

 

WHEREAS, the City of Hampton (the "City") is the owner of certain parcels of real property in the City of Hampton, Virginia, more particularly described as follows:

 

(1)               The median of Settlers Landing Road approaching the Settlers Landing Road Bridge from Hampton University

(2)               The northwest corner of Settlers Landing Road and Eaton Street;

(3)               The southwest corner of Settlers Landing Road and Wine Street;

(4)               The median of History Museum Way near the intersection of History Museum Way and Settlers Landing Road;

(5)               The median of Settlers Landing Road east of the intersection of Settlers Landing Road and Armistead Avenue;

(6)               The median of North King Street south of Pembroke Avenue;

(7)               The median of Pembroke Avenue near the intersection of River Street and Pembroke Avenue;

(8)               The median of Armistead Avenue north of the intersection of Armistead Avenue and Pembroke Avenue; and

 

WHEREAS, the City is committed to a vibrant, attractive downtown and recognizes the need for a cohesive brand to promote downtown; and

 

WHEREAS, the Downtown Hampton Development Partnership, Inc., hereinafter referred to as DHDP, desires to donate twenty-four (24) flagpoles and decorative silks at eight locations to the City of Hampton as a public art donation; and

 

WHEREAS, the eight locations are described above, and

 

WHEREAS, the decorative silks are part of a comprehensive visual brand design plan; and

 

WHEREAS, a right-of-way permit is required for the installation of the flagpoles; and

 

WHEREAS, Hampton City Code 2-134 requires gifts to the City whose fair market value is Five Thousand and 00/100 Dollars ($5,000.00) or more shall be approved by the Council, and the gift from DHDP is in excess of such amount; and

 

WHEREAS, the Council of the City of Hampton is of the opinion that it is in the best interest of the City to accept this gift.

 

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HAMPTON, VIRGINIA: That it accepts the donation of the twenty-four (24) flagpoles and decorative silks from DHDP to be installed pursuant to a duly issued right-of-way permit at the locations as described above as part of a continued commitment to a vibrant, attractive downtown.

 

Adopted at the regular meeting of the City Council of the City of Hampton, Virginia, held on June 10, 2009.
