RESOLUTION INCREASING HODGES AND HODGES ENTERPRISES, LTD. CONTRACT DATED APRIL 2, 2008 BY MORE THAN TWENTY FIVE PERCENT (25%) TO ADDRESS UNFORSEEN SITE CONDITION CHANGES IN THE MAINTENANCE DREDGING OF SALT PONDS CHANNEL AND AUTHORIZING THE EXECUTION OF A CHANGE ORDER TO THE CONTRACT WITH HODGES AND HODGES ENTERPRISES, LTD. AND APPROPRIATING $30,000 FROM THE BOND CONTINGENCY ACCOUNT

 

WHEREAS, Hampton City Council recognizes the public interest in providing through its dredging of public waterways the most efficient means reasonably available and affordable to efficiently address changing site conditions at the Salt Ponds Channel dredging project;

WHEREAS, the City presently has a contract with Hodges and Hodges Enterprises, Ltd to perform maintenance dredging at the Salt Ponds channel for $48,000.00;

 

WHEREAS, it has come to our attention that the current planned maintenance dredging of the Salt Ponds is not sufficient to enable reasonable boat access to Salt Ponds Marina by the public and Salt Ponds residents, and further maintenance dredging is required at an additional cost exceeding 25 per cent of the present contract price;

 

WHEREAS, Hodges and Hodges Enterprises, Ltd. is the most practical source to continue to provide dredging services due to project equipment and personnel already deployed in the maintenance dredging of the Salt Ponds Channel and Hodges and Hodges Enterprises, Ltd. has the knowledge, background and experience to complete the dredging process and;

WHEREAS, the price at which Hodges and Hodges Enterprises, Ltd. will provide these services has been determined to be fair and reasonable;

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Hampton, Virginia as follows:

 

1. That the contract with Hodges and Hodges Enterprises, Ltd. for providing maintenance dredging services for Salt Ponds Channel may be revised to provide for a contract price in excess of twenty five percent (25%) of the original contract price as set forth in Virginia Code Section 2.2-4309 A;

 

2.                  That the City Manager or his authorized designee is hereby authorized to negotiate and execute the contract amendment with Hodges and Hodges Enterprises, Ltd. reflecting the intent object of this resolution in recognition of Hodges and Hodges as a sole source under the circumstances described herein; and

 

3.                  That $30,000 is hereby appropriated from the Bond Contingency Account to fund the additional contracted services.
