Resolution Authorizing the Grant of an Encroachment, Pursuant to 34-86 of the City Code, to Merryman Grounds Maintenance, Inc. of 1,260 Square Feet, More or Less, Onto City-Owned Right of Way Known As Ranhorne Court for a Display Area

 

RESOLUTION

WHEREAS, the City owns the right of way known as Ranhorne Court (the Property);

 

WHEREAS, Merryman Grounds Maintenance, Inc. operates a landscaping/hardscaping business located at 10 and 11 Ranhorne Court and requests the use of an area comprising 1,260 square feet, more or less, of the Property adjacent to its business address to display an array of its inventory, including paver designs, fire pits, and walls as illustrated on Exhibit A attached to the accompanying Encroachment Agreement; and

 

WHEREAS, pursuant to 34-86 of the City Code, the City agrees to grant Merryman Grounds Maintenance a revocable license for the encroachment under certain terms and conditions.

 

NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Hampton, Virginia, as follows:

 

1. That the Encroachment Agreement between the City of Hampton and Merryman Grounds Maintenance, Inc. is approved; and

 

2. That the City Manager, or her authorized designee, and Clerk of Council are authorized to execute and attest the Encroachment Agreement, as set forth in this Resolution.

 

 

Adopted at the regular meeting of the City Council of the City of Hampton, Virginia held on April 8, 2015.
