SAYLOR, party of the second part, and DONALD P. RITZ and CAROL S. RITZ, husband and wife, parties of the third part, and JEAN M. KERSEY and PAULA M. SPADY, parties of the fourth part. WHEREAS, the party of the second part is the fee simple owner of Lots 11 and 12, Block 14, Willow Beach (APC 12001694), and that the parties of the third part are the fee simple owners of Part of Lots 13 and 14, Block 14, Willow Beach (APC 12001695), and that the parties of the fourth part are fee simple owners of Lots 15 and 16, Block 14, Willow Beach (APC 12001697), and they constitute all the owners of land that abuts that certain street, alley, fifteen feet (15) in width to be vacated, more particularly described as follows: Being on the easterly side of East Taylor Street between Lot 12, Block 14, Willow Beach, and Lot 13, Block 14, Willow Beach, as shown on that certain plat of WILLOW BEACH of record in the Clerks Office of the Circuit Court for the City of Hampton, Virginia, in Deed Book 63, page 298, and running back therefrom a distance of one hundred thirteen feet (113), to which reference is here made for a more particular description thereof; and WHEREAS, it is the desire of the parties of the second, third and fourth parts that the heretofore described easement (or street, alley or right-of-way) be abandoned; and WHEREAS, the City of Hampton, Virginia, acting by and through its City Council is of the opinion that the heretofore described easement (or street, alley or right-of-way) is not now and will not be needed for public interest. NOW, THEREFORE, in accordance with Section 2.05 of the City Charter for the City of Hampton, Virginia, the City of Hampton, Virginia, acting by and through its City Council at its duly held meeting on the ___________ day of _______________, 2006, does by these presents release, quit-claim, and vacate unto the party of the second part the following described property, to-wit: the southerly one-half of the aforesaid alley, being seven and one-half feet (7) in width abutting Lot 12, Willow Beach, for a distance of one hundred thirteen feet (113). And, unto the parties of the third part the following described property, to-wit: the northerly one-half of the aforesaid alley, being seven and one-half feet (7) in width abutting Lot 13, Willow Beach, for a distance of sixty feet (60). And, unto the parties of the fourth party, the following described property, to-wit: the northerly one-half of the aforesaid alley, being seven and one-half feet (7) abutting Lots 15 and 16, Willow Beach, a distance of fifty three feet (53). IN WITNESS WHEREOF, the City of Hampton, Virginia, a municipal corporation, has caused its name to be signed hereto by its Mayor, Ross A.
