Call to Order
1.07-0660Comprehensive Annual Financial Report
ACTION: Presented by Karl S. Daughtrey, CPA, Director of Finance; Robert G. Bielat, CPA, Cherry, Bekaert & Holland, LLP; and Sylvia L. Shanahan, Controller. Mr. Daughtrey commended the members of the Finance Department for their excellent work.
2.07-0680Discussion of Status of XL Development Project.
ACTION: Council , at the request of Mayor Kearney, heard from the Manager about the XL Corporation project. The City Manager indicated that XL had failed to wire a sum of money required for closing which is a failure to comply with the terms of the development agreement. Additional details are to be provided to Council during closed session.

Regional Issues
3.07-0628Report on Hampton Roads Chamber of Commerce 11th Annual Inter-Regional Visit to Cincinnati, Ohio.
ACTION: Presented by Councilman Charles N. Sapp.
New Business
  Mayor Kearney also briefly reported on the National League of Cities Conference in New Orleans. He attended along with Councilwoman Leary and Councilman Washington. Mayor Kearney reported that he met with Mayor Nagin and other officials there to compare the flooding problems in both cities. The City Manager will be sending a team of two to meet further on this issue.

The Mayor also reported on the Hampton Roads Center for Civic Engagement, a group on which Hampton will have representation on the Board of Directors. This will includes Assistant City Manager Mary Bunting, Sally Grant-DiVenuti of the City's Conventions and Visitor's Bureau, and former City Manager Bob O'Neill. Clyde Hoey, formerly of the Virginia Peninsula Chamber of Commerce will serve as Secretary of the group.

The Mayors and Chairs met last week and the Mayor reported on a resolution that was considered asking the General Assembly to allow localities to enforce no smoking bans in restaurants. Mayor Kearney shared that he voted no because he wasn't given the opportunity to discuss the issue with the Council prior to voting on behalf of Hampton.

The Mayor also reported that the Hampton Roads Military and Federal Facilities Alliance also recently met and reported on growth in Naval Amphibious Base in Little Creek. He also reported that Frank Roberts, the CEO of the Alliance recently met with Wanda Mims, the VA Medical Director. The VA is an economic engine for Hampton.

Mayor Kearney indicated that several individuals from Hampton have been working on the Cybercomm initiative.

The Hampton Roads Partnership also recently met and discussed the Governor's initiative on preschools. The issue of the drop out rate also came up.

Mayor Kearney is serving on the Superintendent's group with respect to a Career Academy, which is a workforce development program in the high schools.

The Hampton Roads Economic Development Alliance met last week and talked about six prospects that have come to Hampton through the Alliance. A delegation of 15 from China recently visited Hampton. Two of them will be back to speak to the Economic Development department of Hampton.

Councilman Washington asked for information from legal on the 'No Smoking' issue which will be considered by the General Assembly.

Councilwoman Leary thanked the Mayor for not voting on the no smoking issue pending a discussion by Council.

The City Attorney looked at the question of our authority to ban smoking in restaurants. This was initiated at the request of Dr. Berg. She has concluded that the City doesn't currently have the authority and would have to request a charter change to be granted the authority.
