Call to Order
  Mayor Ward called the meeting to order. She explained that the City Attorney sent a letter to the lot owners of the property known as White Marsh Beach on April 19, 2011, inviting them to designate a spokesperson in favor of city action and one opposed to city action who will each be allowed to speak for ten minutes. Mayor Ward asked if such individuals had been identified. John Vosco indicated that he would be speaking on behalf of the Grandview Islanders for the Environment. Sebastian Plucinski indicated he would be the other spokesperson.
1.11-0125Staff Briefing on White Marsh Beach
ACTION: Presented by Greg Goetz, Land Development Services Manager, and Cynthia Hudson, City Attorney. The City Manager, Mary Bunting, and Assistant City Manager, James A. "Pete" Peterson, also presented information.
2.11-0126Spokesperson for Lot Owners in Favor of City Intervention
ACTION: Presented by John Bosco spoke on behalf of Grandview Islanders for the Environment. Mr. Bosco responded to questions posed by members of Council. In response to a question from Councilman Moffett, Capt. K. Ferguson of the Hampton Police Department spoke indicating the officers are trained to not get involved in private property disputes. Chief Tracy Hanger provided information in terms of the availability of emergency services to the area in question.

ACTION: Presented by Sebastian Plucinski who indicated that he had prepared a presentation that he would forego so as to not take additional time and he would instead make the presentation available to Council.
4.11-0127Public Comment Period - 3 minutes per speaker
ACTION: Held Public Hearing The following individuals spoke: Catherine Freel, Cody Tatum, Lawrence Hillstad, Anne Butcher, Cheryl McCrary, Guy McCrary, Mark Feltner, Paul E. Kline, Larry Spencer, Bud Hurst, George Burbanck, and Lynn James.
5.11-0151Council Discussion
ACTION: Moved to formally direct the City Attorney’s office to take all necessary legal measures to shift the existing White Marsh Beach easement, of which the City is a land owner with an expressed interest, back onto walkable land.

This motion died for lack of a second.

MOVER: Councilmember Christopher G. Stuart.
ACTION: Moved to formally direct the City Manager and City Attorney’s office to take all necessary actions to sell, gift or donate, the city-owned acreage on White Marsh Beach to a not-for-profit organization or conservation entity.

No vote was taken as a substitute motion was made.

MOVER: Councilmember Christopher G. Stuart.
SECONDER: Councilmember Will Moffett.
ACTION: Moved to substitute a motion that we study the issue in terms of making a determination about the feasibility and the validity of selling that particular piece of property and then make a judgment at a subsequent time.

Councilman Moffett withdrew his second to the previous motion.
